GREER, S.C. A federal judge won't dismiss a lawsuit accusing BMW Manufacturing Co. of discriminating against black job candidates with a job screening policy at its Greer manufacturing facility.
U.S. District Judge Henry M. Herlong Jr. denied BMW's motion for summary judgment in the suit filed by the U.S. Equal Employment Opportunity Commission.
In 2013, the EEOC accused BMW of violating former employees' civil rights by using criminal background checks with a disproportionate effect on black employees and applicants.

It is. Blacks, racist, corporations, guaranteed to be bogus.
What this is about is that liberals think blacks should not have criminal background checks for employment because so many of them are criminals, and checking their criminal status is “racist”.
No one should discriminate against people with criminal records?
And they wonder why companies outsource.
They would have to go after BMW showing a pattern, if no pattern no win in the lawsuit.
Lawsuits are the reason people can’t easily hire ex felons. if anything happens you get lawyers looking for 1000% awards because you knew the hire had a criminal record.
This is the government’s contention that criminal background checks should not be performed on prospective job applicants.
They are also testing the “disparate impact” theory.
They were doing criminal background checks.
How on earth could that be discriminatory?

For one person it is not, if they are discriminating for all Black people then there would be a pattern.
Sounds to me like this suit should go nowhere.
On each “Employee” Candisate” they found, there was a Yellow Sheet as long as my arm, and my arm’s 17 inches long.
In a country where someone can become its President without having to pass a background check, why should a background check be necessary for employment at an automobile plant?
This is the government we’re talking about. It is entirely possible that they’ll rule that BMW cannot fail to hire a black applicant with a criminal record, AND that the company is liable for any judgments resulting from the employee’s future criminal behavior.

“Racist” has come to mean anything that puts a black or a brown in a negative light, regardless of how truthful it is.
A secondary definition is: failure to give a black or a brown whatever they want when they want it, irrespective of whether or not it’s deserved or warranted in any way.
Background checks is racess!
They should go to the logical extreme and mandate affirmative action goals for black felons. That’s what’s coming. It used to be that your parents and teachers warned that committing a felony would pretty much destroy your life.
It’s the new fad called “ban the box”. Where you check on an application if you have a criminal history or not.
EEOC is pushing it pretty heavily. They’re saying that if the criminal charge has no bearing on what the employee does, then it should not be used for determining if an employee gets that job.
So if your public company’s policy is no criminal history for the last 7 years (or something similar) and you don’t hire one of the “special” individuals for a position within your company. The EEOC will come after you.
Private companies or semi safe from this, but I guarantee you that the EEOC is just waiting for a test case against a private employer.
