Citizen seems to notice a police officer driving around and around his neighborhood while he is working on his boat in his driveway.
Police officer doesn't like being filmed by someone in his own yard and decides to stop and pull gun on him.
Otherwise known as a "commanding tone." Proven by the cop's response to the taper's refusal.
Watch the video again, the officer never raises his voice and speaks in a calm, firm, professional manner throughout the encounter.
YOU watch the video again! The officer takes a well known attack posture, immediately!
The only one speaking in an agitated, agressive manner is the taper.
Because the cop is preparing to shoot him!
That the taper has more nad than you or the cop is immaterial to whether he was being given a lawful order.
Weren't the rest using Voodoo?
If the cop was “preparing to shoot him”, it was because he was refusing to remove his hand from his pocket and thereby actinf in a threatening manner. If the idiot showed his hand so the officer didn’t have to worry about him drawing a gun and killing him, any thoughts the cop had that he might be forced to shoot would have gone away.
Legally, the officer could have given him a firmer command and if he continued to refuse to show his hand, he could have aimed his gun at him and if he continued to to refuse, he could have shot him.
The officer used a fairly low level of force and did not escalate the situation despite the idiot’s dangerous behavior.
The law, common courtesy and common sense all say that if a cop wants to see your hands you show them, period. If you think the initial encounter was unjustified, file a complaint or lawsuit. Deviate from this legal requirement and wise behavior at your own risk.
You are comparing a cavity search to an instruction to take your hand out of your pocket so the cop knows you won’t shoot him?
If you don’t know the difference, I’m not shaking your hand.
Your position is as fatuous as blaming the burglary victim because he didn’t lock his doors.
Furthermore, “The law, common
courtesy and common
sense,” are subjects the police are specifically trained to manipulate for the purposes of securing arrests and convictions, and are therefore specious bordering on disingenuous as a guide for dealing with law enforcement.
None of his freakin business where the guys hand is, he’s standing there on his own property bothering no one. I would have told the cop I was scratching my Schumer.
Your analogy makes no sense.
The taper was not a victim of anything. He behaved like an idiot and if he had another officer, who didn’t remain extremely calm and who instead escalated the situation when given ample legal grounds to do so, he could have been shot to death and the shooting would have been 100% legally justified.
Yes it is the officer’s business. Bullets cross property lines quite easily.
I don’t think the officer immediately needs to explain what the encounter is for. In this particular case, he wasn’t given the chance as the taper refused to show his hand and immediately became agitated, escalating the situation.
Now you see bullets in the video? You must be related to the pig.
WRONG! And that's the part you don't get. ANYTIME an agent of the government intrudes into your life, AS an agent of the government, without cause, you are a victim.
How is it that raising ones voice, and refusing to be ordered around on their own property by a LEO giving unlawful orders is “provocative” to you, but drawing a weapon and presenting it in the low-ready position, with several tentative moves to bring it into full firing position, is not?
I think about all the times someone has been told to show their hands or unbuckle a seatbelt only to get shot when doing so “because I thought he was reaching for a gun.”
It looks like we've almost managed to find a situation where everyone agrees that a cop was decidedly out of line. Just one hold-out on this one.
Interesting thread.
I'll be interested to see how his department reacts. Haven't seen that yet.

He needs to show his hands. A lawful command and a totally reasonable request.
“If the cop had shot him, it would have been his own fault.”
Are you sane? Have you been drinking? Just took a hit?
He had his hand in his pocket and refused to take it out. For all the officer knew he had a gun and was about to kill him with it. The issue is easily remedied by him showing his hand.
Whether the man was on his own property or not was irrelevant to the officer’s safety. The relevant issue was what he might have his hand or the pocket his hand was in.

Thank you Laz! You saved me saying the same thing!
Show your hands. It is the law and any even marginally rational person will do so immediately as it could save your life.
Can you name 3, with links?
