Lawyers for presidential frontrunner Donald Trump are taking a page out of The Sopranos playbook with The Daily Beast for resurrecting nasty details involving an alleged rape that emerged during he and Ivana Trumps early 90s divorce case.
The story by Tim Mak has relevance since Trump recently accused Mexicans of sending their worst people you know, rapists over the border.

As Proverbs says, however, the end of a thing is better than the beginning.
I like Trump’s protests. However, in the end he can’t make such a threat stick.
By the way, each one of us can practice this fact at the local level.
We each live in a town or county serviced by one or two local radio stations, one or two local television stations, and one or two local newspapers. Each of these media outlets carries the AP or Reuters or CBS or NBC or ABC wire service. Each of these has chief news editor. This news editor lives in your town, just down the street from you. He has children going to school with your children. He attends the same local arts events. He eats at the same restaurants. He has a telephone. You can call him. You can call him with the itemized factual evidence of his 1) journalistic incompetence or 2) intellectual political fraud every single day. All you have to do is spend a bit of time with pretty much any national or international news story, documenting the ommissions (mostly), falsehoods, misplacement of newsworthy details, faulty analysis, etc., and confront him with it. You can do this every day.
We could have little teams in every little town of America doing this. Our editors would get a phone call every day.
Mocking. Ridicule. Sarcasm. Embarassment. But mostly providing fact-by-fact-by-fact evidence of the man's personal dishonest. To his face. To his name. To his house. To his family. To his community.
These media people really are scumbags and we should start treating them as such.

Scumbags would not gain an inch if it were not for people who buy scum.
And that’s the problem trying to beat scumbags using scum before a scum loving audience. At best the results are fickle.
If Trump sued the Daily Beast and the reporter for this article, the lawsuit would not survive a motion to dismiss.

Trump’s going to have to get serious that there is something beyond the juice and the “cracker” if he wants to really gain ground. Otherwise he will have simply served as a spectacular piece of bait on behalf of the devil to lower, rather than raise, the level of society.
Document it: settlement is not losing. But an attempt to do something on the scale of what Trump threatens WILL be met with the ACLU.

To be the devil because God uses the devil to bring the evil low... still earns the devil’s reward. Sorry, Satan gets no get out of hell free pass here.
Papers they win all the time in these suits, too. And, more relevant here, when writing about litigious people (or potentially litigious people), like Trump, they tend to write their articles in such a way as to be lawsuit-proof.
Any litigation based on the Daily Beast article would fail. There is no cause of action for slander, or anything else, in that article.
Also, the threshold of proof to make slander accusations stick is higher with public figures than with John Q. Private Citizen.
Donald makes himself public like this... he should expect this sort of thing, and to show that it cannot bait him (”this is all unfounded allegation and I’m simply not talking about it any more”) is to reflect a greater strength.
Trump needs to stop acting like a schoolyard bully and start acting like a statesman. This constant tit for tat with the press and other Republicans is getting tiresome and starting to resemble a bad soap opera.
His constant flame throwing is distracting attention from serious discussion of important issues.
I recall when Bill Clinton would insert himself into every angle of every story that was reported. What a self absorbed bore he was.
Trump is doing the same and it’s getting every bit as boring.
And there would be a lot of classy ways to refute such trash. The “power” in the Beast article is not even in what it alleges Trump may have done, but in the false moral equivalencing behind it. Suppose he forced himself on his unwilling but legal wife... oh, we wish this is the worst that illegales did, “rape” wise!
Someone like Cruz could make moral mincemeat of the Beast. For Trump to rage, inadvertently reinforces the moral equivalencing.
There doesn’t have to be. They can put it in the courts for years and dry out the DB’s bank accounts anyway. $100,000 for Trump is nothing, but no journalist can withstand that in lawyer’s fees. Trump can win by losing.
