'Give me a break!': Donald Trump blasts media in sarcastic, taunting statement
Business Insider via Yahoo ^ | July 7, 2015 | Colin Campbell

Real-estate magnate Donald Trump is out with a fiery new statement mocking the media for its coverage of his presidential campaign.

Trump's Tuesday statement focused on ESPN, which canceled an upcoming tournament at a Trump golf course, and NASCAR, which is moving an upcoming banquet from a Trump resort.

Both moves, the Republican businessman said, are not a big deal at all.

"The disassociation of ESPN and NASCAR with the Trump Organization was covered by the press in headlines all over the world as though it was a major setback for me. Really? What were the losses?" Trump asked.

He added that he would now be able to rent out space to new groups of people, boosting his profit margins, and that both ESPN and NASCAR would be losing their deposits.

Trump also extensively praised the properties the events were scheduled to take place at.

"One NASCAR banquet in a magnificent ballroom at Trump National Doral in Miami for which I will keep their very substantial deposit and rent the ballroom to someone else that night — in other words, two fees instead of one (NASCAR has already apologized to me)!" Trump exclaimed. "In the case of ESPN ... they lost a large deposit. I will now let people use the course on that day, receiving substantial additional greens fee income. Again, I get two fees instead of one."

ESPN cancelled, very likely breaching their contract with Trump.

The purpose of ESPN’s deposit was (a) as partial payment of the amounts owed under the contract and (b) to provide security against any damages caused if ESPN were to breach the contract by backing out of the event.

Now, here’s the important part - if Trump secures another event to replace ESPN, any amounts received from the replacement event count against (e.g., decrease) the amount of Trump’s damages resulting from the breach. It’s basic contract law.

So, if Trump were to secure another event at the same (or higher) price as he was charging ESPN for the event they cancelled, then his damages fro
ESPN’s breach would be zero. He would be made whole. And, in that instance, retaining the ESPN deposit would be an impermissible windfall.

Again, basic contract law.

Nuff said, the rest of your post is gibberish crap. Quit digging.

Hey, idiot, I never said they didn’t breach the contract. Everything I have said on the topic has been about what remedies are available to Trump for that breach, if he mitigates his damages by booking another event.

What you call gibberish is, once again, basic contract law.

But I guess I shouldn’t expect too much from you. I mean, how smart could you be if you support a liberal, corporate-welfare-driven clown like Trump as a so-called “conservative” candidate?

There are plenty of other choices just as good or better.

That's what gets me with these PC corporations. If they had a captive market, that would be one thing, but when there's SO much competition, people can just take their money elsewhere and nor be inconvenienced.

Once ESPN backed out, the contract became void. You troll, are the idiot. Go hump someone else’s leg

The law sets forth the types of damages a party can (and cannot) recover based on a breach of contract. It is not a free-for-all once the contract becomes “void.” You are spewing nonsense about which you know nothing. Absolutely nothing. And you are calling me a troll and an idiot. Brilliant.

Guy, I deal with contracts and contract disputes every day. You calling me clueless is, well, hilarious. But sure, keep calling me a troll for correctly pointing out that Trump said something that’s bound to get him into some legal trouble. And for pointing out that Trump is a pathetic liberal clown who has sucked on the government teat for his entire career, and has the nerve to try to position himself as a “conservative.”

Yes. Contract Law 101 - if a non-breaching party mitigates his losses, the amount of damages he is entitled to collect from the breaching party is offset by the amount of losses that were mitigated.
