Judge To Oregon Bakers: No Free Speech For You [On top of the $135,000 fine]

By decree of the great state of Oregon, the owners of Sweet Cakes by Melissa must pay $135,000 to the lesbian couple whom they “mentally raped” by refusing to bake their wedding cake. This was expected, but the final judgment, handed down last Thursday, came with another twist. Aaron and Melissa Klein have also been given a “cease and desist” order, which effectively decrees they must refrain from stating their continued intention to abide by their moral beliefs.

Land of the What-Was-That?

Let’s be clear on why this is so sinister. There are times when speech rights conflict with other legitimate social goods. The public’s right to know can conflict with individual privacy rights. Sometimes threats to public safety warrant keeping secrets. There can be interesting debates about intellectual property rights. These cases can get tricky, and we should all understand that speech rights necessarily do have certain pragmatic limits.

None of those concerns apply here. The Kleins did not threaten public safety. They violated no one’s privacy or property rights. Rather, the Oregon labor commissioner, Brad Avakian, wanted to silence them because the content of their speech. Presumably he was angry that the Kleins’ defiant stance had earned them a potentially profitable reputation as heroes for religious freedom. They were meant to be humiliated and cowed; instead there was a real chance they would land on their feet. So they had to be gagged to prevent that from happening.

If the First Amendment doesn’t apply to a case like this, it is meaningless.

What is that? Do you have a link?
Originally I gave something to the Kleins on 'Gofundme', but the cowards at Gofundme shut that one down after a couple of sodomites complained. Franklin Graham has set up a Persecuted Christians in the USA for people like the Kleins, but I had not heard of 'Continue to Give'.

In a way, this is great. The new court order shows the huge overreaching of the lower court.

This will ride the rocket to SCOTUS, and even the two lesbians on the court will have trouble with this.

This might not even make it past the 9th Circuit/Circus in SF!

SIGH. 4 justices in the SCOTUS are already COMPROMISED and two others are UNRELIABLE.

I have completely lost faith in seeking justice from the highest court in the land.

Thanks for the link on #46.
I had previously donated at GoFundMe, right before they shut it down (the claim was that that the money donated prior to the shutdown would still go to the Kleins), and later to Samaritan's Purse's Persecuted Christian category. Thanks for the 'Continuetogive' link - I had not heard of that one.

Didn’t they go to several bakeries before they found the Christian one to harass? Or was that the situation with the florist?
All these cases happened around the same time and clearly were orchestrated shakedowns by the HRC. RICO laws apply here IMO, but lawyers on FR would know better than I. Criminal conspiracy to commit extortion?
There is NO evidence to support that the couple suffered any loss, nothing in the law allows me to point at you and say, you hurt my feelings, now gimme some money.

The Kleins, as long as they’re very careful not to overstep, should keep doing exactly what they’re doing— continuing to exercise their 1A rights and letting Avakian spew venom and dig his own hole. This guy is asking for a multimillion dollar lawsuit. What the Kleins have suffered DOES rise to that level.
Plus they should sue Gofundme site. Violation of 1A rights, their right to legal defense, due process, equal treatment, free association etc.
Rant off. Lol.

Isn’t there a big organization of lawyers that are totally dedicated to the pro bono defense of 1st amendment cases especially where the perpetrator is the government?

Yes, I believe there is. This is such an egregious lack of professionalism by the judge that I do not believe the couple will have much problem getting a pro bono lawyer.

However, think the judge's name should be publicized widely.

It is probably not wise to count on the Roberts court any more.
