Commentators have missed the real significance of Justice Antonin Scalia’s dissent in the gay marriage case. He calls the decision a judicial “Putsch,” an attempt to overthrow a form of government—ours. His dissent, joined by Justice Clarence Thomas, was written “to call attention to this Court’s threat to American democracy.”

Scalia understands the power and meaning of words and he chose the word “putsch” for a specific purpose.

Hence, Scalia is saying this was not only a blatant power grab and the creation of a “right” that does not exist, but a decision that depends on public ignorance about what is really taking place. It is our system of checks and balances and self-rule that has been undermined, he says.

In that sense, he is warning us that we need to understand the real significance of this decision, and go beyond all the commentators talking about “marriage equality” and “equal rights” for homosexuals. In effect, he is saying that the decision is really not about gay rights, but about the future of our constitutional republic, and the ability of the people to govern themselves rather than be governed by an elite panel making up laws and rights as they go.

Maybe he should stop speaking in code and get in the trenches where the low information voter lives and tell the truth. Same for all those wise conservatives in Congress, get on the floor and speak the truth.

I'm not confident of anything coming out of the Congress passing, because it ultimately will have to be an over-ride of a veto, and that requires 2/3 of each house. See below. If I'm wrong on this, then I'm more than open to correction. I hear candidates talking about amendments, laws, impeachment, etc., and I look at the 75%, 66%, and 66% votes required, AND I KNOW ABOUT IT, so I wonder why those folks don't know about it.

In my opinion, the only way forward on this is nullification. As you've noticed NOT ONE governor has called for such action. NOT ONE has called for demonstrations in the street. In fact, over the weekend NOT ONE Christian leader that I've heard of has called for Christians in the street protesting, and I've heard of no such protests anyplace. I've heard them saying "civil disobedience" and by that they mean they personally won't marry homosexuals. Well, that kind of action will not be forced by the new tyranny for some time.

We will within 2 decades, imho, be the old Greco-Roman culture, which the Apostle Paul operated in effectively, but with danger. Polygamy will become law. Drugs and prostitution will be legal. Idol-based religions will flourish. In my opinion, we are entering 'the great falling away."

I suppose revolution/rebellion is another way forward, but I doubt seriously that people who won't get in the streets to protest will get in the streets to fight.

Article I, Section 7: "Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States;[2] If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively. If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law.

Every Order, Resolution, or Vote to which the Concurrence of the Senate and House of Representatives may be necessary (except on a question of Adjournment) shall be presented to the President of the United States; and before the Same shall take Effect, shall be approved by him, or being disapproved by him, shall be repassed by two thirds of the Senate and House of Representatives, according to the Rules and Limitations prescribed in the Case of a Bill.

You are correct. I am getting pretty sick and tired of all of these stories going after the supremes and their decisions. Congress has the power if they want to us it but they won’t b/c the supremes give them cover.

I wish all the conservatives would move from their states to one contiguous geographic location of the US (Texas, Oklahoma, Southern states and whatever states contiguous with those want to join us). Seal the borders.

And then we just start ignoring Federal evil laws and judicial pronouncements, stop taking federal money and stop sending them taxes except for specific national security issues - nullify and at some point secede if necessary. Tell them we (the new confederacy) will vote as a block on national security issues but other than that cut the ties, starve the beast. So that we who are Christians are not forced to either ignore our consciences or disrespect authorities.

I think if all conservatives were concentrated in one geographic area it could be done.

If so, exactly who is going to determine the facts about someone working to undermine the Constitution of the United States, and who is going to carry out those just sentences prescribed for those acts of treason, if the court(s), highest elected officials, military, and appointed national civil law enforcement authorities are all corrupted, and working for the enemies of our Constitution and their twisted aims?

(Pretty sobering and frightening questions to ponder.)

But questions that need to be asked.
Biblically, we must respect our authorities. I don’t think indivicuals can Biblically take this on. I DO think that duly elected governing leaders can Biblically address this (Senators, state governors, etc).
This is where Article V can be not only a constitutionally correct procedure but also a Biblical procedure.

I believe any articles passed via Article V need to have disciplinary measures and penalties proscribed. And those measures should be executed by the States. The U.S. Congress is never going to enact penalties on anyone at the Federal level.
And we need to be praying, praying, praying.

I agree. I think of all the work Paul did and his trials. Paul wrote so many books of the NT. He has a distinct way of writing. A friend sent me a John MacArthur study Bible and I have thoroughly enjoyed it. I am afraid the SCOTUS were as mistaken as the Sadducees were when Jesus told them you are mistaken not understanding the Scriptures nor the power of God. Sadly, chaplain I am very disgusted and upset with this country. How could every general officer and every man in both houses of Congress allow our military to become infected with homos and lesbians? Who stood up and said -NO? None that I am aware of.

Sodom and Gemorrah is the USA. I pray some wake up.

I am of two minds about the gay marriage decision. I don’t like the Supreme Court effectively creating this “right.” But I take some satisfaction when I think about what these gay guys have gotten themselves into. They’re going to learn what it is like to work 80 hours a week to start a business and buy a house only to find after ten years of nonstop work, a court stops in and gives half of your business to your worthless stay at home “spouse” and the house as well. Marriage, hey, you guys are welcome to it.

Don’t get me wrong, marriage can be a great thing. But the government should stay out of it. Now the gays have welcomed the government into it. I think a good many of them will rue the day.

“Congress could fix this by simply passing a law stating that no issue on the constitutionality of any state or federal law may be heard by any court other than the Supreme Court and that the Supreme Court cannot overturn any state or federal statute on constitutional grounds unless 7 of the 9 justices concur.”

That would have prevented the Supreme Court from striking down a local law prohibiting the ownership of handguns (5-4) and the Citizens United case (also a 5-4 decision).

I am glad to see this properly framed. The Left has been toiling for over 80 years to gain control of the public agenda; they have worked to control education and the media - to control access to information of young minds.

Fifteen years ago I was posting on FR that we are being ruled by an oligarchy... now my warning is becoming obvious. With the appointment of Breyer and Kennedy patriots could still hold confidence that the Constitution would prevail - through the SCOTUS. However, with the appointments of Kagan and Sotomayor it became obvious that the goal is not to reinterpret the Constitution - it is to overthrow it, to nullify it!

Naturally, many Republicans understood this and voted to confirm them anyway... Then you have Gorge W. appointing a covert Leftist Chief Justice cum traitor revolutionary while presenting him as a strict constructionalist - a Constitutionalist.

It cannot be surprising that Americans - while planning their weekend BBQ's, considering another car and coping with a stagnant economy - let their freedoms slip away but it is becoming undeniable. When individual choices were eliminated in Egypt a short while back over thirty million people took to the streets and overthrew a choking tyranny. Does anyone here on FR think that we could motivate 30 million Americans to take to the streets to demand restoration of their Constitutional rights?

Unhappily: I doubt it.

Obama would veto. There will be very little push back. Those with the most to lose are on our side and will delay reacting for personal reasons. A few that do react will be labelled extremists as they are dispatched.
