Virginia will begin the process to remove the Confederate flag from state-issued license plates, Gov. Terry McAuliffe announced Tuesday, calling the emblem divisive and hurtful.
McAuliffe said that a recent U.S. Supreme Court ruling allows states to decide which emblems to allow or not allow on license plates. He said that the decision supersedes previous federal court rulings that required Virginia to issue Sons of the Confederate Veterans plates that include the iconic image of the red flag with a blue X.
His announcement comes a day after South Carolina Gov. Nikki Haley called for the removal of the Confederate flag from the grounds of the states capitol in Columbia.
As Gov. Haley said yesterday, her state can ill afford to let this symbol continue to divide the people of South Carolina. I believe the same is true here in Virginia, McAuliffe said in a statement. Even its display on state issued license tags is, in my view, unnecessarily divisive and hurtful to too many of our people.
Virginia does not fly the flag of the former confederacy at its state capitol in Richmond, once the capital of the South. But in 1999, the General Assembly allowed the specialty license plates for the Sons of the Confederate Veterans. Although the legislation attempted to preclude the flag from being displayed on these plates, court rulings forced the state to allow a depiction of the banner.
McAuliffe says that hes directed state transportation officials to devise a plan to replace these plates as quickly as possible.
Last week, the U.S. Supreme Court upheld Texas refusal to issue a license plate displaying the flag and rejected a free-speech challenge. The court found that Texas can limit the content of plates because they are state property.

SCOTUS said that the state should have final say on what was appropriate for personalized license plates. Everything that I’ve ever seen regarding personalized license plates has affirmed that they have the discretion to determine what is appropriate and what is not. Propriety is a subjective critter and there are always going to be those who don’t get what they want.
If you choose to see this as a Niemöller moment then buckle up buddy because you ain’t seen nothing yet.

I know its not right and my experience has been that most Southerners are polite and tolerant towards others. As well, Ive seen more hate and intolerance here in the Northeast.

Would you want to be a candidate in 2016 running for office having supported this meaningless gesture, “feel good” moment of voting to remove a flag from the public square? What happens when it is another deranged, evil, young man that does it wrapped in the U.S. Flag? Instead of standing up to bullying (on the part of liberals, media, etc.) and calling evil for what it is and failing to speak out on the continuation of failed policies on poverty, education, the breakdown of the family and culture, feckless politicians take the expedient path to what they think (in the case of Republican politicians)will lead to the “other side” liking them more. We have ISIS running amok in the Middle East, our borders are pourous, Russia and Nato gearing up for a renewed Cold War, China thumbing their nose at us in the Pacific (not to mention owning our debt), Iran laughing at us as we cede ground continually on nuclear negotiations, and an economy that is at zero GDP and a false unemployment rate, and we’re all atwitter about a “flag”. Rome truly is burning...

The state implies a legislative body, not just a governor.
“The 1950s and 60s Civil Rights Movement was great with this. The Bus Boycott was planned long before Rosa Parks refused to give up her seat. In fact, there was a previous candidate, a young girl who did the same before Parks. Unfortunately for her she was pregnant out of wedlock, so the Civil Rights leaders dropped her and waited for a better candidate. Who they got in Parks.”
I read a book about the 50s. There were several chapters about the civil rights movement that mentioned what you described. MLK and the other leaders knew that if they just waited that eventually somebody would do something so horrific that it made staying neutral impossible.
The book also mentioned that the civil rights leaders looked for situations that had an easy to hate villain, like Bull Conner or Lawrence Rainey.

One would think. In SC’s case, the flag was moved not that long ago to the memorial, because of the flap at that point in time. Now, the goalpost has been moved to putting the flag “in a museum”. Given time, will the goalpost be further moved to eliminating it from any museum, in order to salve the tender sensibilities of the Perpetually Offended?
No, no change of heart, but it is a pretty stupid topic. I can’t defend flying the old Stars and Bars over a government building in the Union, but at the same time, it’s ludicrous to act like this dopey issue of the flag going to solve racism in either direction.

It is terribly difficult for Conservatives, who--however we may differ among ourselves as to particular priorities--still recognize the need for some sort of moral compass; to really understand the hatred--not idealism or altruism--but pure hatred that drives the Egalitarian/Collectivist in the war on reality. Exactly. I was wondering if “Pawn Stars” will be precluded from dealing in Confederate artifacts and collectibles? Surely “Gone With The Wind” should be banned, as well. The state can no more prohibit one sort of speech than they can another, and they are obligated by the 14th amendment to treat everyone equally under the law.
They don't get to exercise "discretion" when it comes to freedom of speech on public property. There is no "permitted" speech, and "prohibited" speech.
And your argument "The supreme court says so" is just a variation on the theme of "might makes right", which come to think of it, seems to be your answer for a lot of other sorts of tyranny as well.

In reviewing the Virginia state statutes (you see, I'm kinda funny about the rule of law vs. your feeeeeeeeeeeeeeeeeelings) it looks like there may be a loophole that you might be able to squeeze through (I hope you don't get stuck with your huge cranium).

§ 46.2-726. License plates with reserved numbers or letters; fees.The Commissioner may, in his discretion, reserve license plates with certain registration numbers or letters or combinations thereof for issuance to persons requesting license plates so numbered and lettered.
But specific to the SCV plates they forgot to include the discretion language:
§ 46.2-746.22. Special license plates; members of the Sons of Confederate Veterans.On receipt of an application therefor and written evidence that the applicant is a member of the Sons of Confederate Veterans, the Commissioner shall issue special license plates to members of the Sons of Confederate Veterans. No logo or emblem of any description shall be displayed or incorporated into the design of license plates issued under this section.

There, I've done your footwork for you - now you can file suit with the state of Virginia and demand your "confederate" plates.
