Documents supporting the seizure of 27 vehicles from those reportedly involved in the May 17 Twin Peaks shootout reveal new details of the escalating turf war between rival biker gangs and their support groups that clashed with deadly results after a motorcycle association meeting was moved from Austin to Waco.
Prosecutors filed notices Tuesday of their intent to seize and forfeit 17 motorcycles, eight pickup trucks and two SUVs, alleging the vehicles are contraband used during the commission of the noon-hour incident that left nine bikers dead, 20 wounded and 177 jailed on engaging in organized criminal activity charges.

The Cossacks are not members of the local COC&I and the Bandidos are. However, the Cossacks consider Waco “their territory and made the decision to take a stand and attend the meeting uninvited,” according to the court documents.
“Cossacks threatened that Waco was a ‘Cossacks town’ and nobody else could ride there,” the records state. “The large number of Bandidos and their supporters showed up to the Region 1 COC&I meeting because the Bandidos wanted to have a show of force and make a statement that Waco was not the Cossacks’ town.”

The documents in this report make it clear that both the Bandidos and Cossacks (and their support clubs, if their superiors informed them) logically expected and were certainly prepared for armed confrontation.
Yes, in a public place. Yes with innocent civilians there.
Knowing the history of their previous confrontations, yes they did indeed ride to a public restaurant knowing and expecting that a violent confrontation could and most likely would take place. Sorry if that is not consistent with your romantic view of 1%ers who leave civilians out of it and don’t bring their conflicts into the open. Sorry, but that is exactly what happened.
Maybe the stakes were just too high, in the framework of their priorities. Waco is Cossack territory, despite being in Texas which the Bandidos claim as their own. The Confederation Chapter which otherwise meets in Austin, met this time in Waco, challenging the non-member and therefore uninvited Cossack Clubs on their own “turf”. Maybe the Bandidos scheduled this one meeting in Waco for that normally innocent Confederation meeting in order TO challenge the Cossacks on their “turf”. ??
These documents show that both gangs were ready for confrontation, and confrontation they got.
One of those present at Waco had been stabbed in a previous confrontation in 2013.
The videos referenced and the LE witnesses at the scene determined that the Cossacks were checking their weapons before the other Bandidos arrived. That with the previous incidents of Bandidos — Cossacks disputes including hammer attacks and outright murder at the Gators venue earlier in the year, gave the LE enough indication that the Cossacks were not Boy Scouts on the scene.

One would not think they could be so stupid, but . . . there you have it.
As the testimonies on this report indicate.
The stakes must have been high for their various criminal enterprises to square off at Twin Peaks. Yet they did.
To the credit of the Confederation, they called off a thousand bikers protest riding through Waco a Sunday or two ago. So, take that as evidence of what sense you credit them with. I am also grateful that the situation was not escalated by a Confederation protest, for there were and still are some both Bandidos and Cossacks held and there was no need for their dispute to erupt at the Court House.

Let's break it down. The report makes it crystal clear: at every point, the Bandidos were the aggressors in this escalating "turf war" that has been going on at least since 2013, since a club of Harley enthusiasts calling themselves the Cossacks decided to wear a patch that says "Texas" on their vests.
The ONLY "document" or evidence that the Cossacks attended an open public meeting "uninvited" -- the only source according to this news story you consider a "document," is the same only one that maintains that the Cossacks are a "criminal street gang," and that is, simply, "according to court documents."
The Bandidos are known bad-ass dudes, up there with the Hell's Angeles. Everyone acknowledges this -- they don't need no steeeking documents. Look at their faces at the link compared to the Cossacks. The Bandidos have been on a short list of criminals for gangs that "law enforcement identify as criminal street gangs" for years, and long been known among Bikers as dudes who are really bad, like Mongols and some other clubs.
They are proud to be identified as outlaw bullies and murderers and robbers, cruel extortionists, and they use fear as a weapon, as this story of "escalating tensions" between Cossacks and Bandidos illustrates.
Looks to me like the Cossacks are doing the job the cops should be doing -- standing up to these thugs and telling them to take a hike.
As per this news story, the only real "evidence" against Cossacks as anything other than men standing up to thugs, frankly, is he-said-she-said "police intelligence" accusing Cossacks of crimes for which they have apparently zero to piddling actual records.
Out of 27 individuals, 12 were Cossacks or Cossack affiliated, and 15 were Bandidos or Bandido-affiliated.
Four of the 12 Cossacks had arrest records, no mention of convictions. Charges included DUI, unlawful carry, marijuana, and aggravated assault with a deadly weapon.
Of the 15 Bandidos, 7 had arrest records and many convictions. Charges the same as the Cossacks PLUS theft, theft of vehicle, assault theft of vehicles, "dangerous drugs," manufacture and delivery of controlled substances, possession of narcotic equipment, even assault on a child.
The Cossacks are doing what the cops should be doing: protecting their freedom of association and their freedom to ride where their Harleys when and where they please wearing what they please.
Interesting sidenote -- the Cossack "Rattlecan" who had gone to one of the Cossacks on this list (a chapter president) and told him "to bring as many of their guys to go just in case the things went bad," was shot killed during the "shootout."

My musing off the release of the affidavit:
Chief of Police Brent Stroman has stated that his men were sitting in their vehicles when the violent altercation began. The affidavit that I read at the source Of another thread http://www.nbcdfw.com/investigations/Dallas-Bandido-Opened-Fire-in-Waco-Shootout-Police-308261651.html seems to rely a lot on review of recordings.
Question arises: Is it best practice when LE is onsite, ostensibly off intel that trouble was in the wind - is it best practice to be chillin’ in the cruiser?
If they are chillin’ in the cruiser, do they have a view of the guys who seemed to be forming up, adjusting and checking weapons?
If, instead of chillin’ in their cruiser, they actually had their feet on the ground and eyes on the scene, would other options have been available other that firing into the middle of the violent altercation?
The affidavit presents a picture of an escalating situation over an unspecified period of time. Chief Stroman’s statement presents a picture of a PD caught flat footed.

Yes the Cossacks should stand up to the Bandidos, according to their own logic, and if no one else would. They did take the worst of it at Waco apparently. Sadly, according to their logic, the Bandidos would also defend their illegitimate claim to the entire state of Texas. I am heartened to hear of your disgust for the Bandidos.

The cops should be catching criminals who do crimes, not playing the bad boy biker referee in the games clubs play.
It's too late now, in any case. The harm has been done, the die has been cast, the anchor's been thrown. From here on out in America, "bikers" will be monitored and policed, regardless of who or why, and everybody will think everybody else thinks it was necessary, a necessary evil to having a civilized society. After this they will retain that power to destroy the financial and personal lives of anyone they please, in any club they deem to consider a "criminal" or "domestic terror" enterprise.
They've just shown they can do it and how.
The Waco PD has admitted to firing twelve rounds from high powered rifles “in a public place with innocents around.” Nothing the bikers are alleged to have done that day shows such a callous disregard for bystanders as that.
