OVERTON, TX (KTRK) -- Police in Texas shut down a lemonade stand run by two little girls. They said it was illegal.
Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father's Day present. They wanted to take him to Splash Kingdom.
They had been selling lemonade and kettle corn for an hour - and made about $25 - when officers showed up and told them they need a $150 permit to sell their lemonade.
Texas House Bill 970, or the Texas Baker's Bill, does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since lemonade needs to be refrigerated to prevent bacteria growth, police said they needed an inspection from the health department and a permit to sell it.
"It is a lemonade stand, but they also have a permit that they are required to get," Overton Police Chief Clyde Carter said.

I’d certainly buy some roasted goat and wash it down with cold lemonade.
when I lived in Alaska years ago a family friends kid had a snack stand that they ran during the summer. the town was really small and on an island. we got tour groups in on Sunday after noon and there was no stores anywhere that the tourist could buy anything except a liqueur store that had very little choice except in the area of booze.. there stand would make about 50 dollars in an hour selling home made cookies and lemonade. this was the only way the kids got spending money . I think if the kids did not open there stand the local police would be doing a welfare check at there house to see if everything was all right

so it surprises me to see something like this in a small Texas town.
Here in Maine, kids, and even adults sometimes set up roadside table/stands in small towns selling lemonade and all kinds of food products.....the authorities.....politicians and police.....don’t bother them.
I went to a yard sale in a tiny community in a Maine coastal town some years ago. The woman and her kids were also selling homemade donuts, which were some of the best donuts I ever ate.
I don’t care one wit for those McKinney pool goons but THESE kids are genuine victims.

Did they slam the girls to the ground? Throw a flash bang into the nursery? Tass their invalid Grandmother? Shoot the families dog? No? Well they got off lucky I’d say.
Oh, the horror of those of us who sold un-refrigerated lemonade as kids. Good thing the statute of limitations has run out! :-)
Yeah, maybe they’re following the idea of
the best way to get a stupid law repealed is to enforce it completely.
Sue the bastards that passed the law in the first place.
The police are actually doing the community a favor by drawing attention to this stupidity.
Maybe that’s where they’re going -
people will buy American lemonade from a couple of little white blonde girls,
but won’t buy roasted goat from some Somalis -
and that would be racist,
so we have to have laws against both.
I’d support the muslin selling goat as well.
