A second Ellis County man bonded out of the McLennan County jail after he was arrested three weeks ago in connection with the biker shootout on May 17 in Waco.
Midlothian resident Brian Logan bonded out on a $25,000 cash bond at 12:05 p.m. on Monday, said Cathy Edwards, indigent defense coordinator for McLennan County. Maypearl resident Don Fowler was bonded out on a $25,000 surety bond by 6:30 p.m. on May 3 according to the McLennan County jail inmate list. Both men had their bonds reduced from $1 million to $25,000 before they made bond.
Fowler and Logan are two of six Ellis County residents who were arrested after the shooting. On May 17, an altercation broke out between rival biker clubs at a Twin Peaks restaurant in Waco, according to arrest warrants from the Waco Police Department. Members of the biker clubs and Waco police officers exchanged gunfire. Nine people were killed in the incident and 18 others wounded, according to the reports.
Midlothian residents Robert Clinton Bucy, Jarrod D. Lehman, Christian A. Valencia and Red Oak resident Valdemar Guajardo Jr. were also arrested and charged with organized criminal activity, which is a first degree felony, and booked into the McLennan County Jail. The other four men were still in the McLennan County Jail according to the inmate list on Monday morning.
The district attorney's office said on June 3 because Fowler's case is an open, active criminal case and an ongoing investigation, the office cannot and will not comment or address any questions, so it remains unclear as to why Fowler's bond was reduced. The district attorney's office had not responded to questions about Logan's case by press time.
Fowler and Logan retained their own attorneys, Edwards said. Fowlers attorney said he did not wish to comment at this time.
Logan's attorney, Reed Prospere, said the next step in Logan's case is to wait and see if the district attorney's office decides to prosecute Logan's case.
“I'm confident once they get time to get all their ducks in a row, and that may take months, that there will be no charges filed or charges will be dismissed,” Prospere said.
He said the DA's office, like other DA's offices in small towns where a large event happens, is overwhelmed. He believes many people arrested at the event were caught in an unfortunate situation and will not be prosecuted.
“Brian was there to talk motorcycling and have a day out on the deck talking motorcycle safety,” Prospere said. “It is unfortunate that people have to suffer as a result of that incident.”
The process to get Logan's bond reduced was very professional, Prospere said.
“I could not have been treated any nicer in regards to my request for bond reduction or when I was there this morning,” he said Monday.
According to The Waco Tribune-Herald, some bikers who had their bonds lowered to $25,000 have had other conditions included in the bond agreements including that the men stay out of McLennan County except for court dates, wear ankle monitors, abide by curfews, and don’t associate with biker groups.
Logan's bond reduction agreement did not include any conditions, Prospere said, and the DA's office never requested any special conditions. Normal conditions include promising to appear for court dates, not engaging in criminal activity and not contacting witnesses, he said.
As of press time, it was unclear what conditions, if any, came with Fowler's reduced bond.
Sounds like the Prosecutor has a vise on his balls and he is playing nice to get all those mean ole defense attorneys
from making a laughing stock out of him.

Oh, I think we all know why. Waco has just trumped Austin as being the most hated city in Texas - Just Keepin' Wacko Corrupt. It is going to pay dearly for its behavior. New businesses will reconsider moving there. Parents will reconsider sending their kids to Baylor. Its taxpayers will be on the hook for the trials, the three squares and cots not just for those in the city but more so for those being held around the state, and the inevitable law suits. It will likely lose its customers who live in the country and drive into Waco to do their shopping. I know I'm never going to stop there. On the way to Dallas, I'll take 340 around most of the city and wait to eat at the Czech Stop in West and fill up at the gas station next door. Waco is officially off my list. Good riddance.

Anyone who does not a vested interest in some criminal motorcycle gang is a fool to think they can garner respect and favor from those gang members. The next time they meet on the road, they will be damn lucky they don’t get shot or have their “Hog” stolen by the very outlaws they now mistakenly defend.
