An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.
Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.
He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.
Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.
Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.
After the shootout, in which nine were killed and 18 wounded, Reposa said officials commandeered the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

I've seen AMA sponsored clubs, Harley Owners Group folks, Pagans MC members, Vietnam Veterans MC members, Christian Motorcyclist Association riders, various ABATE groups... ...the list is practically endless.
In past years I have attended it on a "crotch rocket" (both with a sport-bike group and an ABATE Chapter), on an old Triumph with a few "brit-bike enthusiasts, on a Harley Softail with a group of independent "bikers", and on a BMW R100RS all by myself.
It is a truly diverse crowd.

I also see that the spring-loaded cover over the ejection port appears to be open, as is the case when live rounds have been fired and ejected.

That's not necessarily proof of firing and ejection, brother archy. Having once owned one of these fine firearms, before that tragic boating accident, I found that the dust cover opened pretty much any time the bolt moved significantly. Operating the action; firing; ejecting without firing -- all opened the dust cover.
Who the heck needs brass knuckles to deliver toys to kids?
Somebody who's been set up for an attack by another biker bunch made up of snitches or informants? Indeed, if I'd had a couple of my outfit's members shot by a sniper in another nearby state last February, and then a bunch of Texas cops start using rifles on other bikers, I might want a whole lot more than just brass knucks.

But since the cop in the pic still has his trigger finger straight-fingered away from the trigger, it's a fair bet he still has one up the spout, whether from having fired a couple of rounds previously, or from having chambered one without firing.
Maybe the investigators from the Justice Department's Civil Rights Department will ask him about that. Remember if the Katrina/Danziger Bridge rules apply, he gets six years in a federal pen if he lies.
