Maddow Blasts Law Requiring Aurora Shooting Victim's Parents To Pay Gun Manufacturers

Maddow opened her show with heart-rending footage of the Aurora trial. She highlighted the testimony of Brenton Lowak, whose friend Jessica Ghawi -- a 24-year-old aspiring sports reporter -- died in the shooting.

The parents unsuccessfully sued the retailers who made the firearm that killed their daughter. Colorado state law requires that plaintiffs who sue the manufacturers of gun products pay the companies' legal fees if they lose.

“That’s not a typo,” Maddow said, adding, “The mother and father of the victim who died in the Aurora mass shooting have just been ordered to pay a quarter-million dollars to the gun makers who sold the bullets that were used in the Aurora mass shooting -- the parents of the girl who was killed.”

I would guess so. But this case was absurd, and it went through.

It might be worth the PR bump to waive the parents from paying, if that’s allowed.

Seems that would quickly undermine the law to the point where it could hardly be used.

It sounds very much like a pure nuisance suit just trying to shake ( extort)!some money from a “deeper pocket” than maybe the proper defendant may have.

I wonder if some Bloombergian donor has been backstopping this suit all along. That way, the parents can pretend to whine about the $250K with no actual risk to themselves, and they can be used to make the case for repealing "loser pays" laws nationally. The anti-2As have been itching to use this phony liability concept on gun-makers for years.

Thats what liberalism demands. The perp can’t be at fault because that would entail responsibility for ones actions. That would violate the sacrament of ‘personal truth’.

Besides, there’s no money in it. Lawyers are one of the greatest contributors to the DNC. It’s why they sue any and everything. They profit, donate and laws are made to increase their profit.

The one time I had to show up in person for a potential jury pool, one of the cases up was a woman who was involved in an auto accident with a vehicle owned by a utility.

She was suing every body even remotely involved, including the bank that provided financing for the vehicle, the vehicle lessor company, etc.

Fortunately for me, I didn't get picked for the one case that ended up going to trial, the others settled at the last minute.

I doubt her lawyers would have wanted me any way, having a problem with such an approach, let alone hearing any of the actual details.

There you hit upon it. The lawyers don’t care if the family is screwed by this decision. They would take up to 50% if they won, but they only lost their overhead as it is. If you want to make frivolous lawsuits end, don’t make the plaintiff pay opposing counsel make the plaintiff’s lawyer pay. They can promise the naive client anything, and then walk away and leave them holding the bag.

If one were to side with that hank of a hairball. If some one driving a car, did damage to me or my kin then i could sue ; Car manufacturer,oil and tire companies, associated with that vehicles operation!
Colorado has a law that says that wont happen, in that state!

LOL! If he did, I hope they got the last part in writing!

I feel sorry for these people if they were counseled to push for this in the suit. They've been violated twice, if that is the case. Once by the shooter, and again by the shyster.

Of course, a strong sense of justice, despite having experienced the grossly unfair, might have caused them to just say "no" instead of proceed.

I could go with that. But I’d still like to see the plaintiff take responsibility for their part at some level as a warning to others so inclined.

Granted, nailing the lawyers would prevent a lot if not nearly all such suits, but the hardcore ‘faithful’ will always find one. I compare it to the Sharpton/Jackson shakedown stuff. Even if you locked all the race hustlers up, you’d still have the ACORN types who are not ‘officially’ affiliated that could find a stooge to front their causes.

Lawyers are absolutely the enablers, no question. But IMO, not the core problem. That core is the legal lotto players.

TLDR: Make it hurt.

I can’t feel sorry for the victim’s parents because they sought to shift the blame from the actual criminal and onto innocent persons. The parents DESERVE to lose. NO,a thousand times NO, to forgiving the legal costs. And if a bunch of idiots want to donate through GoFundMe or any other method ,that is fine;it is their right to throw their money away. The companies should not have to factor defending frivolous lawsuits into the price of legal products.There is entirely too much legal extortion which is encouraged by insurers who take the safe way out and buy off the complainant regardless of merit..
