O’Malley reacts to Tsarnaev verdict: ‘Death penalty is ineffective as a deterrent’

Former Maryland Gov. Martin O'Malley said Friday that the death penalty sentence for Boston bomber Dzhokhar Tsarnaev was “ineffective.”

While the likely Democratic presidential candidate said that he “respects the verdict of the jury” and said his prayers go to the victims and their loved ones, he used the occasion to make another statement on his opposition to the death penalty.

“The death penalty is ineffective as a deterrent, and the appeals process is expensive and cruel to the surviving family members,” Mr. O’Malley said, Mediaite reported Friday. Mr. O’Malley added that “the vast majority of public executions” happen in the U.S., North Korea, Iran, Iraq, Yemen, and China, and said that was a list the U.S. should not be on, Mediaite reported.

Liberals like O'Malley consider ignorance to be a badge of honor. The death penalty is definitely a deterrent to capital crimes, other crimes not much. But then, no sensible person would expect the death penalty to deter crimes that are not punishable by death in the first place.

Among the many reasons the Tsarnaev family are despicable is that they have been leaches on tax payer supported welfare.
Unless O'Malley wants to personally pay to keep this murdering muzzie POS alive I submit that Tsarnaev's verdict be carried out promptly.

In 1972 the SCOTUS ruled out capital punishment nationwide in Furman v Georgia. After Georgia (and other states) corrected discrimination problems, the death penalty was reinstated in Gregg v Georgia 1976.

During the four years from 1972 to 1976, capital crimes increased dramatically. In the years following the 1976 decision, they dropped back down to their previous baseline. The two cases had set up a compelling, naturally controlled experiment.

The data may have impacted the Court because in subsequent cases, regarding execution of mentally handicapped and minors, the Court cited deterrence effects as a significant factor in their thinking.

I agree that the appeals process is far too extended. But the blame for this is not the thing-in-itself, the death penalty, but lies entirely at the feet of abusive federal judges who personally disdain the death penalty, so have erected considerable petty obstacles to it being carried out.

Since congress determines the behavior of the judiciary inferior to the Supreme Court, just two people could readily change this: the respective chairmen of the senate and house judiciary committees.

They could do so by making some common sense changes to federal procedure that would in *no way* make the appeals process less fair, but would reduce the time wasted in the process by half or more. For example:

1) Declare the states to be “competent authorities” in carrying out death sentences. This would mean no more nit picking by judges over the *means* of execution. In effect it would declare that “normal means” of execution, such as lethal injection, electrocution, the gas chamber, the firing squad, even hanging, are excepted from arguments that they are cruel or unusual.

2) Move all death penalty appeals to the front of the federal docket, so they are first heard within, say, one month after being accepted for appeal, not have to wait for years behind dozens of other cases.

3) Limit continuances during the appeals process to one month each for the defense, prosecution, and at the discretion of the judge. Added to the previous change, this would mean a maximum of four to six months spent in an appeal, assuming a lot of evidence needs to be presented.

4) Create a bias against federal judges being able to overturn death sentences, or to issuing instructions to lower courts to do so. Only in cases where there is exculpatory evidence, gross impropriety at the trial level, or gross constitutional violation should they be able to do so. In short, either the evidence proves them *innocent*, or officers of the court will be tried for criminal behavior, or that the unconstitutionality of the execution makes its unconscionable.

Instead, if they support the appeal, the typical instruction is for the case to be returned to the trial court for reconsideration. If the trial court again finds for the death penalty, then the appeal on that argument is set aside.

5) Significant changes need to be made to expedite the federal death penalty.

so does that mean he thinks life imprisonment is a deterrent? Drawing and quartering would probably be a deterrent to at least some of them. But even that might not deter all of them particularly islamic fanatics. then what? what about justice for the families that were savaged?

Of course it would be a deterrent but this is a Liberal speaking.The left wing POS was governor of my state.I read where he set a record for tax increases during his eight years in office.No surprise there.Raising taxes is as natural as breathing to the Treasoncrats. God forgive but how I despise that accursed party

But it is just. True justice is first making a rational moral judgment and then acting to deliver what is rationally deserved in accordance with that judgment.

This guy is considering running for president? Really?

Death Penalty = No repeat offender (Highly effective)

While I have to give O’Malley credit for mentioning the appeals process, doing away with it once the decision has been made to “execute”, enough said. Stop wasting time and money, get it over with.

The government was quick to get rid of Timmothy McVey after finding him guilty of the Oklahoma court house bombing. They got it over and done with quickly and, under Clinton’s watch.

An excellent question. Most efforts by Muslims to kill people involve them believing they are ‘contracted-out’ by their religion to act in behalf of God. God is good enough to do the good work, and apparently is not good enough to do the bad work....so a Muslim must take on such work to show his ‘respect’ to the religion. Yeah, it sounds awful fake and probably is comical...but that’s the selling value of the religion. Do God’s work for him because he can’t do it. Naturally, if you go another couple of lines into the Quran...you need to acquire the guy’s wealth, his property, and take his family as slaves....as part of your reward for doing God’s work.

If someone wrote this type of stuff up today as a religious text....they’d be bluffing people into thinking robbery is approved by God, which would be a total joke of religion.

If Tsarnev, and Morsi, and similar types sit in prison awaiting execution of their sentence, the ISIS types will capture innocents. The West will then negotiate the release of innocents for terrorists. The terrorists will win the propaganda war. the West will look like impotent jerks.
