Murder charges against Freddie Gray cops may be DROPPED because police findings don't support the case, say officials

The murder charges filed against the Baltimore officers who arrested Freddie Gray could be dropped, because the police investigation into his death doesn't support the prosecution's case, it's been reported.

Last Friday, Baltimore City State's Attorney Marilyn Mosby levelled charges ranging from assault to second-degree murder at six police officers involved in Gray's death. He had suffered a fatal spinal injury while in police custody.

However, officials familiar with the case have revealed that police investigators do not agree with the charges. The murder charges filed against the Baltimore officers who arrested Freddie Gray could be dropped

The officials said that the internal probe team do not believe a charge more serious than manslaughter should be brought against any of the officers, according to CNN. RELATED ARTICLES

What's more, defense lawyers are mounting a challenge to Mosby's assertion that the officers had unlawfully arrested Gray because the knife he had in his pocket is considered legal under Maryland state law.

Marc Zayon, the attorney for Edward Nero, one of the officers charged, argued in a motion filed Monday that the knife in Gray's pocket — described in charging documents as 'a spring assisted, one hand operated knife' — is in fact illegal under state law.

“I do believe with this case they are on for the whole ride unless MD law provides that a judge can somehow dismiss such a charge prior to trial.”

A judge can dismiss the charges in a pre-trial hearing on the evidence. These charges each have conditions, and if they are not met, they cannot stand.

What kind of hearing are you talking about? Certainly at a pre trial hearing on the admissability of evidence a judge can suppress evidence on a constitutional basis which generally effectively ends the prosecution. I'm not sure what type of other pre trial hearing allows a judge to rule on the merits of the evidence other than an arraignment where a judge can decide whether the facts offered by the state would constitute the crime charged if true. However, some states do provide for pre trail hearings to determine whether there is sufficient evidence to more forward but not the majority.

Remember when the usual handful on here wanted the officer in Ferguson done?
Remember when the usual handful on here wanted the cops in NY city done for say they chocked the guy?

Now we have the usual handful yet again wanted these cops done. They and many of us know who they are.

Why not wait until all the evidence comes out first and lets make a decision then.

I guess that’s what I was trying to convey. I suppose that the judge can’t direct the prosecutor to dismiss the charges, but he does that de facto by ruling on the admissibility of the evidence. And I will bet that he can also have a “discussion in chambers” and “recommend” a course of action to the prosecutor.

The rushed murder charges were obviously pandering to the mob to quell the rioting.

On the contrary, the move was to INCREASE the unrest. I'm betting the prosecutor/prostitutor knew good and well that the charges wouldn't hold up, thereby fanning the flames of "victimhood."

Oh, it is a win-win for this Leftist witch. She gets to garner support from the parasites for her anti-whitey action, and then, when a grand jury refuses to indict, she gets to juice the parasites up for more rioting and destruction.

Mosby had tried exactly 36 cases while working for an insurance company. She has never tried a murder case.

If they have a Probable Cause hearing, the judge may throw the charges out. She has to either have a PC hearing or a grand jury within 30 days.
