What about this crime is SECONDARY?
And what is it SECONDARY to?
What would be FIRST degree assault? Splashing gasoline all over the teacher and lighting her on fire? Anything less than that is SECOND DEGREE assault?
If the races were reversed this would be ATTEMPTED MURDER and a HATE CRIME.

Dang... I got smacked by a teacher once. When I got home, Momma was waiting
(news travels pretty fast in small towns) and she smacked me again for embarrassing her. And then... Dad came home.
I never gave a teacher a reason to smack me ever again.

I have come to the conclusion that anytime a group attacks a single individual or when someone kicks someone when they are down, they should be charged with assault with a deadly weapon.
