Amanda Knox Case: Italian Court Overturns Murder Conviction

The highest court in Italy on Friday has overturned the murder convictions of Amanda Knox and her ex-boyfriend in the sensational 2007 stabbing death of her British roommate.

The ruling was the latest turn in an odyssey of international justice for Knox, who spent four years in an Italian jail after the killing. She has returned to the United States and vowed not to return to Italy.

She and the ex-boyfriend, Raffaele Sollecito, were convicted in 2009, then acquitted and freed in 2011. An appeals court overturned the acquittals and ordered a new trial, and they were convicted again last year. Knox was sentenced in absentia to 25 years in prison. Sollecito was sentenced to 28 1/2 years.

Knox and Sollecito were arrested after the roommate, Meredith Kercher, was found dead in a pool of blood in their apartment in the university town of Perugia, as many as 40 knife wounds over her half-naked body.

Prosecutors argued that Kercher was killed as part of a sex game. Knox and Sollecito said they were alone together on the night in question, watching a movie, smoking pot and having sex.

Not answering the question doesn’t help yours, either.

What evidence are you withholding from the authorities that she is guilty, since you proclaim her to be guilty so much?

Let’s see your evidence. The courts saw all the Italian government’s evidence and found her not guilty, so you obviously must have more evidence they have not seen. So, were is it?

In fairness to Amanda, she made those comments 24 days after trayvon martin was shot...I agree she owes George an apology, I gave money to George couple times, still stand by him btw

However many people bought into the media coverage early that later changed their minds.

I was with George from day 1, but Amanda was a bit preoccupied. I agree an apology to George would be nice.

Fred does not believe in innocent until proven guilty. And they in fact said she was innocent

BTW NY Post reports it this way.....

The judges declared that the two did not commit the crime, a stronger exoneration than merely finding that there wasn’t enough evidence to convict.

AND

Experts have said such a complete exoneration is unusual for the high court, which could have upheld the conviction or ordered a new trial as it did in 2013 when the case first came up to its review on appeal.

Oh absolutely! Heck the prosecutor himself had a criminal record! It was all a soap opera made for the stage, and this unfortunately at a young woman's expense and her family's.

Mignini is crazy and incompetent. And a liar and a cheat. He is so crazed that he cut a deal with the murderer and lessened his sentence to get him to lie and change his story just so he could get Know.

Remember, first the court found her guilty, then not guilty, then guilty, and finally not guilty.

Is the final court ruling proof that she and her boyfriend are innocent? Did "Not Guilty" verdicts prove that Casey Anthony and OJ were innocent?

The whole deal was a show...Mignini made sure of it...he was going to win this case no matter what avenues he felt needed to be done to make that happen.

Giuliano Mignini was given a 16-month jail sentence after being found 'guilty of abusing his office' during a separate investigation into a serial killer........that trial took place in Italy 'at the same time' as he was leading the prosecution of Knox.....he should have never been allowed to prosecute this case.

This was first claimed by one of Sollecito's defence lawyers, Luca Maori, following Knox and Sollecito's commmittal hearing in October 2008.[7] The hearing was in camera, so we do not know exactly what was said during that hearing, but Giuliano Mignini, the prosecutor, has always denied mentioning a satanic ritual.[8][9] Certainly, the motivation report, written by the judge who conducted that court makes no mention of a satanic ritual as a possible motive.[10] Nor is it mentioned in Judge Massei's motivation report, relating to Knox and Sollecito's trial, so it is beyond doubt that such a motive played absolutely no part in the decision to convict Knox and Sollecito.[11] This myth is so pervasive that it is hard to believe that there is no foundation for it: however, it does not appear in the sentencing reports of any of the courts that have considered this case. It does not even get a passing mention as a prosecution theory that was rejected: it is completely absent. (Read more at link above.)

Myth: Guede cut a deal with prosecutors

From the link above:

Not true. While Knox and Sollecito have recently been alleging deals being offered or deals being made, deals of the sort Americans are accustomed to are not allowed in Italy. All three accused were initially meant to be tried together, and likely were advised of all of their options at the outset. One of these options is what's known as a fast-track trial, usually involving a not-guilty plea but with less evidence presented from either side. For this a one-third reduction in sentence is automatically granted in the event of a conviction—and life sentences are reduced to 30 years. Guede elected to sever his case from Knox and Sollecito, fearing they would gang up on him in a joint trial, and to take the fast-track option. At Guede's trial Judge Micheli imposed a 30-year sentence, the fast-track equivalent of a life sentence, and the harshest sentence that the court could award. By the time of Guede's appeal, Knox and Sollecito's trial had been concluded, with their being given the benefit of generic mitigating factors, such as their young age—hence they were given 24 year sentences for the murder charge. At Guede's appeal, he was credited with the same mitigating factors (he is, for example, younger than Sollecito). The fast-track tariff (one third reduction) means that his equivalent sentence is two thirds of 24 years, which is 16 years. That is the sentence that he is currently serving. Under Article 176 of the Italian Criminal Code, he will be eligible for parole (libertà condizionata) when he has less than five years remaining of his sentence, which will be in 2018. Prior to that, in 2014 Guede will be eligible to leave the prison during the day on work release (semilibertà).

Guede has thus received no reductions in his sentence other than the generic mitigating factors also enjoyed by Knox and Sollecito, plus the automatic fast-track reduction of one third—an option open to Knox and Sollecito which they chose to reject.

OK, then, I guess Knox is entirely innocent.

I suppose her claim that she saw a local businessman commit the murder was just an innocent misunderstanding. And she kept changing her story because she’s just a misunderstood person.

And, of course, the mix of her blood with the victim’s blood in the apartment was due to an entirely innocent set of circumstances.

The bloody footprints that matched hers and her boyfriend’s, her boyfriend’s DNA on the victim’s bra clasp, the DNA of both Kercher and Knox on the knife at Sollecito’s apartment - all evidence that can innocently be explained away somehow.

On second thought... Nope. Not buying into the Not Guilty verdict. It doesn’t add up.

My sympathy goes to the family of Meredith Kercher.

agreed.

Imagine if your daughter was in Italy, just happened to be at the wrong place at the wrong time. She is falsely accused, your neighbours in the States are either saying she is guilty or they do not know if she is guilty (really same thing)

How would you feel?

She has been completely exonerated, not just that there was not enough evidence, but they totally exonerated her, cleared her, and some of your neighbours continue to say they are either unsure or that she is guilty, you would not feel good about them, and you would be right.

There is a ton of evidence she is not innocent

When I'm on a jury there has to be a ton of evidence that she is guilty. Lying about various things may indicate either guilt or not remembering and trying to get away from a conviction. It is up to the state to provide enough hard evidence to convict. In this case the evidence wasn't forthcoming. She may very well have done it, but "may have" is not enough. There wasn't the physical evidence tying her to the crime and the primary witness seems to have witnessed a lot of murders prior to this event.
