State Department Has ‘No Record’ Of Clinton Signing Separation Statement [VIDEO]

State Department spokeswoman Jen Psaki said Tuesday the agency is “fairly certain” that former Secretary of State Hillary Clinton did not sign a separation statement upon her departure from Foggy Bottom.

“We don’t have record of it,” Psaki admitted.

“Can you put to rest the questions that you have not been able to answer to this point about former Secretary Clinton, whether she signed this separation form or not?” asked The Associated Press’ Matt Lee.

“Well, we have reviewed Secretary Clinton’s official personal file and administrative files and do not have any record of her signing any of the 0F-109,” Psaki said.

Psaki added that they also could not find forms signed by Clinton’s predecessors Condoleezza Rice and Colin Powell either.

“So, when you say that you do not have any record of her signing it, does that mean that there is no such document with her signature on it in the file?” Lee followed up.

“That we have found access to? Yes,” Psaki said.

“Yes, which is why Departmental Regulation (required by the Dept. of State) may have been violated here, but not law.”

If it's required by the State Department and she didn't sign it, I believe she violated the law. She didn't work for the GSA, she worked for the State Department. It was required by the agency she worked for. If she really didn't sign it, the person who was responsible for making sure she signed it, would also be in violation of the law.

OK, so, she didn’t sign a separation agreement.

Next question: Is she still getting paychecks? If so, is she being paid as if she were SecState?

According to 4. of the Form, she would probably be in violation of Section 2071 - Concealment, Removal, or Mutilation of Records. This would apply whether she signed it or not.

Sec. 2071. Concealment, removal, or mutilation generally

(a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

(b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

No, Departmental Regulation does not equal law. Violation of such can result in disciplinary action (to current employees).

GSA provides copies (hardcopy and electronic) of the forms for all agencies to use. For Optional Forms (the OF part of OF-109), they are not mandatory, but may be used by multiple agencies for the same purpose. If there is law in place to say to sign the form, then the law may have been violated, but if not, then no issue (need to find the law itself).

There may be fines and penalties associated with signing the form and violating the terms agreed to, but I don't know what the deal would be for failing to sign the form in the first place. That's what I'm trying to nail down.
