The lawsuit brought against the state claims sheriffs are faced with a "crisis of conscience"
A group of sheriffs will file a lawsuit Thursday against Colorado for its legal marijuana law.
The lawsuit says legalizing pot on a state level while its still illegal on a federal one creates a crisis of conscience, USA Today reports.
Colorado is asking every peace officer to violate their oath, Larimer County, Colo., Sheriff Justin Smith, the lead plaintiff in the suit, said. What were being forced to do
makes me ineligible for office. Which constitution are we supposed to uphold?

Can’t wait for the resident FReeper JBT drug war bootlickers to chime in on this one ...
I guess there were many unforseen consequences after all, eh? We told you so but you wouldn’t listen...
People used to seeing themselves as “The Law” are often unable to come to terms with the legalization of freedom.
Both, if one adheres to the Founder's interpretation of the 10th Amendment.
Weld County Sheriff John Cooke says he won't enforce new gun-control measures, and legal experts say he won't be breaking the law.
Imagine that.
Which constitution are we supposed to uphold?
Which part of the US Constitution gives the Feds the power to ban a naturally occurring substance??
Justin Smith, Larimer County sheriff, says he won't enforce "unconstitutional" gun laws
In part...
Preserving our Constitutional Republic
The United States was very deliberatively established as a Constitutional Republic. John Adams said it succinctly "We are a nation of laws, not a nation of men." Our founding was based on the clear understanding that we are endowed by our Creator with our unalienable Rights. While our Constitution clearly defined these Rights, it did not create or establish these rights and no government official has the authority to take these Rights away.
Wrong premise. It isn't banned at all, it's "controlled".
"Sale" of a controlled substance.
"Distribution" of a controlled substance.
See what I mean? Actions taken with the object are what are punishable.
It could very easily be...sale of a used rifle, or pistol, if such laws existed.
Since when is the local constabulary bound to do the Feds’ dirty work?
No more weed busts must be cutting into their coffee and doughnut fund.
Hey man, Sheriff’s departments gotta get revenue from property forfeitures and illegal seizures, right???
There is a lot of passion on both sides, isn’t there? Considering all the problems the country is facing, cracking down on people using an herb seems silly.
A woman in Appleton, Minnesota was charged with child endangerment for using cannabis oil on her teenage son. He has a traumatic brain injury and the oil was the only thing that eased his pain. Considering that the alternative is pain killers that are based on synthetic heroin(to which a family member of mine is addicted), an herbal oil seems to be the safer choice.
What a ridiculous waste of resources for social services, sheriff dept, court system, etc. But the timing was shortly before medical marijuana became legal and all of these agencies adhered to the absolute letter of the law.
It should be left to the states.
And in this case - Colorado made a bad mistake. From the Governor and now sheriffs, people are waking up and admitting legalization was a bad error in judgment.
These Sheriffs that take on a state right issue like this should lose their next election. The people elect sheriff’s not the federal government. This is total BS. How about these same guys defending the second amendment when the state ignores it?
A trumped-up "crisis of conscience" is inconsequential.
IMHO... it is up to the states. If the Sheriff(s) have such an issue then they should resign. The Sheriff is perfectly able to put in an application for employment with a Federal agency.
Dope smokers don’t care about Federalism or Laws for that matter.
It's not freedom. It mocks freedom. It is childish self indulgence that makes freedom impossible.
It is a "Freedom" in the same manner that "Homosexual Marriage" is a "civil right."
You mean naturally occurring substances like Uranium, Anthrax, Chlorine gas, and other dangers things? Why that would be the defense clause which is an umbrella authorization for anything which threatens the lives of citizens.
It authorizes the Federal government to ban chemical and biological weapons, which is what drugs are.
And of course, mr dope pusher himself has to show up and try to obfuscate the issue.
