A controversial new flyer is helping some people dodge DUI checkpoints, without even speaking a word to the police.
Motorists who pull up to sobriety checkpoints are holding up the “Fair DUI Flyer.” The flyer reads “I remain silent, no searches and I want my lawyer,” along with a short list of state laws.

No, they are not “dodging” the checkpoints.
I strongly disapprove of drunk driving, but I also strongly approve of this effort. Police should be pushed back to their proper role in society, which does not include conducting random stops and random searches without probable cause. If the police wish to pull over a drunk driver for a specific offense, that’s different, but the checkpoints I have seen are unconstitutional.
They sure aren’t. Fox & Friends’ “fair and balanced” language kicking in.
It's a perfectly reasonable and legal request and requirement to present your license upon request by a LEO. If you don't roll down your window, then fine. You *** is going to jail.

The report is saying that the flyer is helping people avoid said ride to the police station with commensurate impound of vehicle. Was that mistaken?
They put their license and insurance and flyer in a ziplock bag outside of their window.
They don't talk to the police or roll down their window to prevent the LEO from 'smelling' any alcohol.
How is a DUI checkpoint any different (besides the obvious purpose)?

So you are saying drunks are doing this?
How about a reasonable middle-ground? Put the window down, show them your license, answer questions, be polite. If they want to do a search, deny them permission. If they insist, tell them you want a lawyer.
If one hasn’t been drinking, doing drugs or any illegal activities, should be ok. My big worry is the license check will show a CCW permit and some cops can be jerks about that.

It is the random stop that is unreasonable (and unconstitutional), though currently legal. The point of the flyer, and this method of having ID visible, is that you are complying with the law without giving the cops an opportunity to “smell alcohol” or hear “slurred speech” or tell any other lie that would allow them to arrest you for a DUI.
In this case if the cops were to take you on the “ride” you may just find yourself with a nice taxpayer funded settlement.
They are presenting ID, they are showing it, which apparently, is all the state law requires. Not handing it to the officer.

Right you are. Another cop trick, used on younger folks, is to "smell" marijuana. In either case, it's just an excuse to ignore the 4th amendment.
