A North Carolina officer shot dead a 74-year-old man whose concerned family had called the police and asked to check on him.
Officer Josh Lefevers arrived at the home of James Allen just before midnight on Sunday morning and announced he was entering the residence when Allen approached him with a handgun and refused to put it down, police said.
Lefevers then shot and killed him.

So to check on someones mental state, the state sends a cop with a gun? The dispatcher and cop should be put up on charges for practicing psychiatry without a medical license.
The cop didn’t take it unto himself to enter the home. He was asked by the man’s family to check up on him, which presumably gives him permission to enter the home if nobody answers the doorbell or knocking on the door.
No, it does not.
There is an Oregon Statute that says that a person is not responsible for their actions for 30 seconds after waking up. I don’t know about the law on this elsewhere.
Perhaps the cop woke up the old man, scared the daylights out of him, and then killed him due to his reaction and reduced cognitive functions.
So much wrong with all of this. At least there was no dead dog as well.
Our next door neighbor, a few years after we had moved away, had this happen. Her husband was suffering from dementia and maybe something else? She called the cops because of his behavior. When he answered the door with the gun in his hand, they shot him. No, they did not try to figure out what his problem was or ask him to put away his gun.
There were no charges brought against the police or anything. It was probably an unnecessary shooting, but what are cops supposed to do if they don’t know the guy or his level of sanity?
Yes they can. If the officer was asked to check up on an individual for medical reasons, and there is no answer, the officer consider that medical aid may need to be rendered and enter the home without a warrant.

One thing they can do, is quit thinking that they can kill everything in front of them that poses any conceivable or possible threat in any and all circumstances, in a sort of preventive sweep.
Next time you call the cops to check on family members, remember to explicitly mention NOT to kill them (or their dogs).
“I’m concerned about grandpa, could you please stop by and kill him?”
A willingness to die in the line of duty, as opposed to a willingness to kill in the line of duty.
That would be rather noble, eh? Therefore, I supposed unionized police will not rise to that level.
If he was having a dementia moment he may not have realized it was a cop, didn’t acknowledge it being a cop, and refused to let the officer retreat.
I tend to wait for more info on stuff like this. It’s entirely possible the officer shot only as a last resort.
That’s in Canada. Not so in America.
Sometimes a willingness to take a risk instead of gunning everything in front of you, especially when we are inside of our own homes and not breaking any laws.
As others said, you can’t use deadly force to wound.
That is why I said that in post 13.
There isn't much evidence of this, really.
If you have a loved one with any of the above conditions, please make alternative arrangements for their wellness beyond calling the po-po.
Your loved ones and family are your responsibility, not a 911 dispatcher's and certainly not anyone carrying a gun!
If they lose that mindset, how are they going to be assured of going home safely each night?
The citizens' safety is always secondary, very obvious these days. Thier safely and collection of pension is paramount. To hell with the peasants, they might impede that quest.
