Fox’s Shep Smith: Same States That Were ‘Fighting Integration’ Are Against Gay Marriage

During his breaking news coverage of the Supreme Court’s decision to hear four different cases challenging same-sex marriage bans in four different states this term — Kentucky, Michigan, Ohio, and Tennessee — Fox News’ Shepard Smith compared the remaining resistance to marriage equality in this country to those who wanted to keep segregation intact during the Civil Rights Movement.

“Not in every case, but in most cases, the same states which were fighting integration are fighting this as well,” Smith said. “Those states which always seem to be behind the curve for reasons which are explainable and understandable. Those are the places where this is going to turn out to be the most difficult, especially if the Supreme Court stays with what has seemed to be a trend toward inclusion and away from discrimination.”

To the Wall Street Journal editor John Bussey’s assertion that “there’s still disagreement on this issue within the American population,” Smith replied, “There’s still disagreement on segregation.”

As Smith reported, by combining the four challenges to state bans on same-sex marriage, the Supreme Court could effectively legalize marriages in all 50 states with its ruling.

The states have never amended the Constitution to expressly protect the gay “rights” agenda, gay marriage for example. So the states are free to make laws which discriminate against constitutionally unprotected gay marriage imo, as long as such laws don’t also unreasonably abridge constitutionally enumerated rights.

Therefore, if Mr. Smith really wants to protect gay marrage then he needs to do the following. He needs to work with state and federal lawmakers to propose a gay marriage amendment to the Constitution to the states. And if the states choose to ratify Mr. Smith’s amendment then the feds will have the constitutional authority through the 14th Amendment to protect gay marriage and Mr. Smith will be a hero.
