Having that black sergeant in charge of that crime scene takes race out of the equation. As awful as Pantaleos actions appear on that video, at no time does that black sergeant order Pantaleo to stop choking Garner.

A choke hold is when the forearm is used to place pressure on the windpipe and there is danger of the windpipe being crushed.
A head lock is when the chin of the perp is in the elbow and in that position it is nearly impossible for the windpipe to be crushed.

All I know is that I tend to JUST WALK ON BY, smile and say no thank you. Nothing to get really angry about.
Now if I see a group of some sort, I will simply go to another store, aka WALK ON BY.

Same for the cigarettes.
It is a *massive* market.
So in terms of police cracking down on Garner, the real responsibility lies with Bloomberg and NYPD Chief Bill Bratton. Idiot laws lead to meaningless deaths.

So it all comes back to liberal mayors (democrat or RINO) chasing after tax money.
I wonder how much NY City invests in policing the sale of "Loosies" as compared to the actual lost tax revenue.
I imagine the City is spending many, many thousands chasing a relatively low value misdemeanor.
Meanwhile, across the street and down on the corner there are probably a dozen guys carrying illegal pistols while they openly peddle dope and crack.
I have been outspoken in defense of Darren Wilson but I have far deeper concerns about the NY case. How can you continue to choke a person who gasps that they can’t breathe? Amazing.

This is the perfect recipe for the sale of black market cigarettes.
When the profits to be made in selling cigarettes bought in a nearby state at a much lower price can easily be $2.00 a pack it will be impossible for the authorities to enforce their confiscatory taxes on cigarettes.
It is also inevitable that there will be deaths like this one in their attempt to enforce the tax.
Take my word for it there will be more deaths until the tax on cigarettes in New York are more in line with the taxes of their neighbors.
You are so right! Why is everyone second-guessing the grand jury? They must have seen evidence that others didn’t. And why would anyone want to be a cop right now? I’ve never seen such hatred of law enforcement as we see today, from all sides.
Every time a cop puts on a uniform he or she is a target for the entire time. Remember the 2 cops who were murdered when they were having lunch in a restaurant? One in our family was a cop for 5 years, and you would not believe the stories - the filth he had to wade through, the patience he had to have in dealing with the dregs of society, the things he saw like decomposed bodies, severed limbs and heads, etc.
That is how you are approached - selling “loosies” or even single packs.
Once they are certain you are safe an offer is made for the cases and larger quantities.
Sounds like what you can expect from a socialist/communist administration: Violent crime can run rampant, but any action that short changes the city on some tax revenue will be dealt with severely.
If you haven't yet read the Breitbart article yesterday, it's a definite must. It fully explains the difference between a choke hold and suppression hold the officer used, and which is sanctioned and taught by the NYPD. Preliminary autopsy showed no injury to Garner's windpipe or neck bones. "According to Garners friends, he 'had several health issues: diabetes, sleep apnea, and asthma so severe that he had to quit his job as a horticulturist for the citys parks department. He wheezed when he talked and could not walk a block without resting, they said.'
He was selling cigarettes, which he has done for a while I guess. Makes me wonder if with all his health issues, he was also a smoker, which would limit his breathing capabilities. Are we going to require our police officers to ask everyone refusing to comply with a lawful order, what their health problems are before force is used to bring them to compliance?

The grand jury exists to ensure that cases are tried that must be tried AND that have some chance of winning.
Those officers appeared to be acting within their discretion in enforcing the law. I assume the grand jury thought that any prosecution would fail.
That said, I don’t think selling cigarettes on the street is justification for arresting anybody. It’s a crappy law that says a guy can’t roll his own and sell them loose.

As a outsider looking on, there is a lack of concern for the citizen. I would have been tempted to enter the arrest process and try to free up the citizen in order for him to breathe easier.
First, anyone resisting arrest has already made a decision that endangers their own life. Everything that happens after that point is on you, including any act performed to subdue you, whether illegal or not. That doesn’t mean others aren’t wrong, but the resistor is nearly always wrong, and was in this case.
Second, it’s impossible to verbally state that you can’t breathe if you’re choking. That’s exactly why people die of choking while surrounded by others. They can’t tell people what’s wrong and have to get their attention in some other way. So, he might have had difficulty breathing (due to a combination of his asthma and the excitement, say), but it wasn’t because of a supposed “chokehold.”
I’ve found that it makes far more sense to let these sensationalist stories play out for as long as a month before paying the least bit of attention to them. The facts that matter are usually suppressed initially, then dribble out and completely reverse the Leftist rants that accompany the original story. Big time saver, and especially true when racism is alleged.
We have real video of the attempt to subdue Eric Garner. And for a petty misdemeanor, of all things. They should have charged the policeman with at least manslaughter.
