A New York City grand jury has declined to indict an NYPD officer in the chokehold case of Eric Garner, the unarmed man who died while being arrested on Staten Island earlier this year.
In opting not to indict, the panel determined there was not probable cause that a crime was committed by NYPD officer Daniel Pantaleo, who was seen on a widely watched amateur video showing him wrapping his arm around Garner's neck as Garner yelled, "I can't breathe!" during the summer altercation.

Just curious ... Did you watch the video? This guy would still be alive if he had simply obeyed the law. Don’t like the stupid NY laws? Then change them. The officers were trying simply to arrest this guy. He resisted. IF you actually watched the video then you might have noticed how much bigger he was than any of the officers. There was NO choke hold that could be seen at all
normally, I would say that his record should come in to play but this guy was selling single cigarettes on the street. Confiscate, give him a ticket and move on. His crime was not worth the attention it received from the police.
Look for more protests.
“remember that this incident started because Garner was suspected of selling untaxed cigarettes.”
I don’t know much about this particular incident, so I am sure I will learn more from my fellow FReepers. That said, your comment above now reflects a death toll from the war on tobacco to be higher than the death toll resulting from “second hand smoke!”
Everything is now a capital offense.
Yeah, I’m thinking this cop SHOULD have been indicted.
That’s not a choke hold.
Correct..how in the hell can a “chokehold” be applied when the guy’s neck is as big around as a normal person’s thigh? It took two arms just to get a grip..one was from under the gentleman’s arm.
The BIG concern is going to be that tonight the yearly lighting of the Christmas Tree in Rockefeller Center is going to be taking place and that must have gotten the folks planning that event very, very NERVOUS now.
N-Y-C.
“I can’t breathe.” Said every little brother ever.
Now the crooks have a simple way out of every arrest.
I’m 3 for 3 (trayvon/mbrown/Gardner) in my jury predictions!
I want to see them riot in Staten Island. DeBlahblah won’t even go there.
It's more convincing when you die.
Probably no petechial hemorrhage in his eyes either.
I can’t wait for all the new protesters to institute the chokehold when protesting - perhaps choking each other.
Maybe they can begin in Congress again.
I have to agree. Without a doubt excessive force was used. I am not sure how they did not get an indictment. The only ting I can think of is that the prosecutor went all in for murder one and did not attempt a lesser charge.
At any rate if you live in NYC ammo up and board the windows its going to be one hell of a week.
Wilhelm canceled his appearance at what he called “the commerce tree” lighting.
I guess he escaped arrest by dying.
Gezzuz...
