Kansas Secretary of State Kris Kobach (R) has denied Democrat Chad Taylor’s request to be removed from the Kansas Senate ballot. His Thursday decision means Sen. Pat Roberts (R-Kan.) will face three candidates on the ballot this fall — Taylor, independent Greg Orman and libertarian Randall Batson — boosting the vulnerable senator’s reelection prospects. Now, Taylor could siphon off enough anti-Roberts votes from Orman, who’s been surging in the race and is now seen by Democrats as their best shot to take Roberts down, to deliver the senator an opening for a win. New Jersey Supreme Court Rules in Favor of Dems Replacing ‘Torch’ on Ballot

TRENTON, N.J. – The New Jersey state Supreme Court ruled Wednesday that the Democratic Party can replace Sen. Robert Torricelli’s name on the November ballot with former Sen. Frank Lautenberg.

The ruling gives hope to Democrats scrambling to retain their one-seat majority in the U.S. Senate through the Nov. 5 election — but Republicans vowed to appeal the decision to federal court.

The 7-0 decision cited previous rulings that said election law should be broadly interpreted to “allow parties to put their candidates on the ballot, and most importantly, to allow the voters a choice.”

The fight over which Democrat will appear on the Nov. 5 ballot erupted Monday after Torricelli dropped his faltering re-election campaign amid lingering questions about his ethics. He was admonished over the summer by a Senate committee for allegedly taking lavish campaign gifts from a contributor to his 1996 campaign.

Late Tuesday, Democrats settled on the 78-year-old Lautenberg as their substitute candidate.

Republicans say it is too close to Election Day to replace Torricelli and that Democrats shouldn’t be allowed to dump a candidate who was trailing in the polls. The GOP also said state law bars replacement candidates less than 51 days before an election; Torricelli withdrew 36 days before Election Day.

The courts have ruled on many occasions that Democrats don’t have to follow election laws if doing so places them at risk of losing.

Quite a while ago, Toricelli (The Torch) was ousted from his NJ Senate seat in a big scandal. It was not legally permissible to replace him due to the number of days remaining before the election. Nonetheless, he was replaced by Lautenberg who won.

What makes you think this time the Democrats won’t prevail?

It’s difficult to see how a Roberts victory is anything to celebrate. If the Republicans gain the majority in the Senate, but many vote like Democrats, then what? A RINO is useless.

It was the Bush/GOP appointed John Roberts that shoved Obamacare down our throats.

With Reid going nuclear, the GOP needs operational control of the senate to block obama’s judicial appointments

The problem here is though, Dems don’t want a Dem on the ballot. Thats the point.

Rules are if he withdraws, he has to have good reason to and if he does, Dems have to replace him on the ballot anyway....They didn’t read the rules..

All moot anyway as Ballots have to start printing tonight. So they have no time now to mess about.
