(RNN) - A North Carolina diner that gained national attention for offering a discount to diners who prayed before their meal has now rescinded the offer.
Craig Marimpietri tweeted a photo from Marys Gourmet Diner in Winston-Salem, NC where a sign noted that while you may exercise your right of religious freedom, by praying over your meal we must protect your freedom from religion in a public place. The restaurant is no longer issuing the discount because, "it is illegal and we are being threatened by lawsuit."
In an interview with Greensboro, NCs News & Record newspaper, Annie Laurie Gaylor, co-president of the Freedom From Religion Foundation said that the group didn't threaten a lawsuit against the diner, but pointed out that it is illegal to charge an atheist more than a Christian."

The guy simply can't afford the litigation.
But you can be pretty certain that there will be a lot of Christians praying in the restaurant at the regular price....and the legal beagles can't do a damn thing about it.

No, but it is illegal for a business that is a public accommodation to offer discounts based on religious discrimination.
They didn’t specify who to pray to. Would they really know if you’re praying to Budda or the Flying-Spaghetti monster? An athirst could just pretend to pray if they wanted.

Because seniors (actually those 40 and over) are a protected class under the federal law, but younger people are not. So, you could charge seniors less than younger people, but if you tried to charge younger people less than seniors, that violates the law.
I don’t think that would matter, as it’s still discrimination on the basis of religion, even if you don’t advocate one religion in particular.
You might be able to win that argument in court, but they say they don’t have the money to fight a court battle, so...

If I remember correctly they didn’t offer the discount to everyone who prayed. They offered it randomly to some people who prayed.

Go ahead and pray, just no discount. And not getting a discount shouldn't stop people from praying.
And because of Jesus' teaching in Matthew 6:5-7, I'd silently give thanks.
