A North Carolina police chief has officially barred officers from making up phony 911 calls in order to gain access to private residences without a search warrant.
Several officers with the Durham Police Department lied about 911 hang-up calls to convince residents to consent to searches of their homes, an officer said under oath in late May, a local ABC affiliate reported.
The allegations prompted Police Chief Jose Lopez to send out an internal memo barring the practice.It has recently been brought to my attention that some officers have informed citizens that there has been a 911 hang-up call from their residence in order to obtain consent to enter for the actual purpose of looking for wanted persons on outstanding warrants, he said in the memo, Raw Story reported.
Effective immediately no officer will inform a citizen that there has been any call to the emergency communications center, including a hang-up call, when there in fact has been no such call.

Yeah, this. There is, technically, nothing illegal about the practice as described (unless they're actually placing fake 911 calls, but that does not seem to be the case here), it's just pretty doggone unethical, and in the end, counter-productive once word gets out that they're doing it, as people are going to start refusing access even when a legit 911 was made.

The way I read the article, the copthugs are lying to individuals in their homes, not to 911 operators. Did I read it wrong?

Geez, I do not know the answer to this. The Supreme Court has already ruled that it is permissible for copthugs to lie to suspects/people/individuals. If a copthug decides that one is a ‘suspect’ then wouldn’t that make it OK for the copthugs to lie to that individual/s to gain entrance to his/her home?

You would think so. But apparently, this isn’t the case.
If someone let’s the police into their house, they’ve probably surrendered their rights, even if under false pretense.
Let me look back to my several arguments here on FR.
There are many here who defend the deliberate lies of a police-officer if it results in an arrest. I believe some of those defender cited court decisions.
I get shot down everytime I argue that a cop, when performing thier sworn duty, can’t openly lie that they are a police officer otherwise it is entrapment. For instance, if you approach a hooker on the street and ask her if she is a police officer, she can obfuscate but when pressed she cannot openly say, “No. I am not a police officer.”, other wise it is entrapment.”
Again, let me look through my records for a court citation. maybe I’ll start a new thread (and ping you in the process?)
Would you please describe how the bogus 911 call could happen? I’ve done a lot of work with phones of various types and that seems highly unlikely to me.

I think law enforcement officials should pay a heavy price when they wantonly violate the public trust and/or abuse their authority.
Agreed and I’m ex-LEO. They are not above the law. Now if only the 0 administration would learn that.
That’s probably why the sheriff is putting an end to it.
The friendly and competent cop on the beat of my childhood (many, MANY years ago) is no more.
Now, they lie about calls to get into your home, then push you to the floor, rough you up, put you in cuffs, and shoot your dog.

Cops are allowed to lie to citizens. You’re not allowed to lie to cops.
