At the center of the seemingly incomprehensible case of Justina Pelletier lies one very simple, and unanswered, question:
What did her mom and dad do to lose custody of their daughter in the first place?
Gallons of ink have been poured on this story since last November, when a Connecticut TV station first reported the story of a sick teenager ripped from her family over a medical dispute between two hospitals. But having read every report on the case, including Judge Joseph Johnstons ruling Tuesday, I cant find a single claim substantiated or otherwise of bad behavior by Lou and Linda Pelletier before their daughter was taken from them.
Not one.
Defenders of the Department of Children and Families and Boston Childrens Hospital insist there must be something SOMETHING to justify the nightmare Massachusetts has inflicted on this family. A teenage girl who was relatively healthy, able to ice skate with friends while under Tufts Medical Center care is now almost immobile in a wheelchair, after more than a year of virtual isolation at a Childrens Hospital psych ward.
Theres got to be a good reason GOTTA be for DCF keeping this girl isolated from her family, allowing them to visit for just one hour a week always under the watchful eye of DCF agents and guards. A reason for not allowing her to attend school, or to attend church on Christmas or Easter.
We treat the accused Boston Marathon bomber better than this, for cryin out loud. So there must be a rational defense for what amounts to the abuse of a poor, sick girl.
Whatever that reason is, alas, it doesnt appear in the public record. And this is a problem. Because the state of Massachusetts has taken a child...

Reason: Egomaniac doctor at BCH won’t admit that the Tufts doctor (also on staff at BCH) is right ... he needs this girl for some kind of paper or thesis he’s working on... and since BCH and DCF are legally entwined it is in their interests that this girl die rather than go back to the treatment that was working for her.

Just wanted you to know the depths of the corrupted attitude of the authorities in this Commonwealth.
The Boston hospital at the center of this mess...and the Boston legal system...have to be awful worried that this young gal might pass away before the 18th birthday. The amount of a lawsuit on this? It could reach up into $500 million against the hospital alone, and the county might have another $500 million that it’d have to find to pay off their side of the mess.
Neither has insurance capable of paying that much off, and it just makes you wonder how many lawyers are now engaged quietly at reminding people just how badly this might go. Even if this young gal survives until 18....she’ll lay in a imprisonment suite and demand hundreds of millions on her own.
What happens if the family just forcibly take Justina?

This is simply a case of the courts allowing the medical zealots to have their own “lab rat” to play with and to do so, they had to take it away from mom and dad.
Nope. Doctors do not have that kind of power—the police state has that kind of power.

One of the points that has emerged fairly clearly is that Boston Children’s Hospital (BCH) procedure for pursuing a commitment of this kind is a well-oiled machine. The BCH physicians and staff on the one hand, and the DCF staff on the other, work closely to prepare their cases, and the courts are usually cooperative. Psychiatric evidence is afforded a high measure of credibility and deference, and, as in this case, the child is routinely ordered to remain at BCH.
The problem with all of this is that BCH stands to make a great deal of money on every child that is court-ordered to remain in their care. The conflict of interest is glaring. Its like a judge routinely sending convicted criminals to a private prison that he himself happens to own. The difference is that any judge who engaged in activity of this sort would be looking at criminal charges and disbarment. But in psychiatry, this sort of thing is common.
The matter is particularly compelling in that reports are emerging that BCH tends to pursue these kinds of court orders in cases where the family has good insurance. Justina was kept at BCH for eleven months. I have seen no reports as to the size of the bill, but Im sure it wasnt trivial.
BCH and Harvard
David R. DeMaso, MD, is the head of psychiatry at BCH. He is also a professor at Harvard, and is a member of Harvards Psychiatry Department Executive Committee. He is evidently highly regarded at the University, and has his own Harvard Catalyst page. Theres a tab on this page labeled Similar People, and one of the people listed as similar to Dr. DeMaso is our old friend Joseph Biederman, MD, the eminent inventor of pediatric bipolar disorder. This is the bogus diagnosis that legitimized the prescribing of neuroleptic drugs to children as young as two years old for temper tantrums. Even some psychiatrists spoke out against this spurious and destructive activity, but the practice continues. The fact that Dr. DeMaso would allow Dr. Biedermans name to remain on his Similar People tab seems noteworthy. There is also a connections page on Harvard Catalyst, listing three publications co-authored by Dr. DeMaso and Dr. Biederman.
Dr. Biederman is on record as promising Johnson & Johnson a positive result for their drug Risperdal if they would fund his study. Why would any reputable physician allow someone like that to remain on his Similar People tab?
I did a PubMed search to see if there were other links between BCH psychiatrists and Joseph Biederman. In addition to the DeMaso publications, I discovered papers co-authored by Joseph Biederman and at least two other members of the BCH Department of Psychiatry Leadership Team: Joseph Gonzalez-Heydrich, MD (7 articles, as recent at 2012); and Deborah Waber, MD (3 articles, as recent at 2012).
The gag order was clearly an attempt to prevent them from drawing adverse publicity to BCHs psychiatry department. Courts are supposed to be impartial. Why would the court in this case have assumed that the psychiatry departments motives were benign, that its diagnoses were valid and accurate, and that its practices were judicious and efficacious? Why did the court not recognize the financial conflict of interest when it ordered that Justina be kept involuntarily in the locked psychiatric ward at BCH?

My wife is an MD psychiatrist on the faculty at a very reputable medical school and I discussed this case at length with her this morning. Bottom line, any physician who refuses to allow other reputable physicians to evaluate their problem cases is opening their career to a death sentence, especially if the patient deteriorates under their care.

OBJECTIVE: To assess longitudinal maintenance of improvements in depression, anxiety, global functioning, and physical health perception in 11 adolescents at 6 and 12 months following completion of manual-based cognitive-behavioral therapy. METHOD: Standardized instruments assessed follow-up changes in depression, anxiety, physical health, and global psychological functioning.
RESULTS: At both assessments, 10 adolescents did not meet criteria for mood disorders. Improvements in depression, anxiety, global functioning, and physical health perceptions at completion of the cognitive-behavioral therapy were maintained during the 12-month period. Additional cognitive-behavioral therapy sessions (mean = 4.36; SD = 4.37) and psychopharmacology (n = 5) were required during the follow-up period. CONCLUSIONS: CBT with maintenance sessions and medication offers promise to adolescents facing comorbid depressive and physical disorders.

Irresponsible and Wrong: Lawyer Hits Back at Judges Leaked Ruling That Includes Accusations Against Justina Pelletiers Parents
“But Mat Staver, the founder and chairman of the Liberty Counsel and whom the Pelletiers requested be admitted as a lawyer onto the case a request Judge Johnston also denied Tuesday said the court order doesnt present all the evidence.
Staver said three psychiatric experts and Dr. Korson testified in court in the last months of 2013. One of the psychiatrists was the one from Boston Childrens Hospital who first diagnosed Justina with somatoform disorder. That doctor maintained a somatoform diagnosis to the court, Staver said. Another was from Boston Childrens who disagreed with the somatoform diagnosis but said Justina had another psychiatric condition known as conversion disorder. The third, Staver said, was a psychologist who had seen since Justina since 2006, well before the custody battle began. This psychologist believed that Justina suffered from a form a depression that resulted from her symptoms with mitochondrial disease. Dr. Korson maintained in court that Justina had mitochondrial disease, which impacts the energy-producing organelles of her cells.
To Staver, this shows that only one doctor insists that she has somaoform. So thats the so-called evidence that the judge is relying upon.”
