HOUSTON A federal judge in Texas struck down the states ban on same-sex marriage on Wednesday, ruling that the laws restricting marriage to a man and a woman violated the United States Constitution, handing gay-rights advocates a major legal victory in one of the nations biggest and most conservative states.
The judge wrote that the amendment to the state Constitution that Texas voters approved in 2005 defining marriage as between a man and a woman and two similar laws passed in 1997 and 2003 denied gay couples the right to marry and demeaned their dignity for no legitimate reason.
Without a rational relation to a legitimate governmental purpose, state-imposed inequality can find no refuge in our United States Constitution, wrote Judge Orlando L. Garcia of United States District Court for the Western District of Texas, in San Antonio....

Who didn’t see that coming? Judges have more power than congress or the people. There is no stopping them.
And that is why it is time to divide the country into two separate nations.

To regulate the actions of ALL people based on 10-20% of the populace walking around with their head up their a$$.
No, just enclaves. Most of America is red. Just encircle the liberal septic tanks of Chicago, New York, Baltimore, etc., and make them deal with their own kind. Anyone attempting a break-out gets capped.
Not so sure. More and more people seem to have no problem with homosexual “marriage”. I think it will soon be celebrated nation-wide, which is why we need to secede. And soon.
76% of Texas voters wanted this law that this judge just struck down.
Hard to have much faith in the American judicial system, eh?
Why not legally define marriage in Texas as the relationship between two (2) people who have the biological means to procreate.
Not easy to miss. I am ready for Texas to give 0 the finger and let the rest of the country fend for themselves without fuel a few months, years or forever.
I’d bake a cake with a giant finger on the top.
Well, as Scalia said long ago, abolish sodomy laws and fag marriage will follow. I guess he was right. The only good news here is eventually they will all be subject to anal injected death syndrome.
Too bad we lost in 1865.
And yet some tell us there is no difference between whether we elect a Democrat or Republican President ...
The AG of Texas should, IMHO, ignore the Federal Judge and obey Texas law.
Sort of like Holder and Obama do.
Except in this case, they would be following the law...of Texas.
Maybe go for an Arizona constitutional amendment. Much better than going to SCOTUS which probably would open the door for more federal unconstitutional usurping of our freedoms.
Hell, it's a perfect pivot point to the 10th Amendment...and an opportunity to tell the Feds that if they send their agents into Texas to preclude the enforcement of Texas law they'll be arrested and prosecuted. And, if they resist, they'll be shot dead.
“Well, as Scalia said long ago, abolish sodomy laws and fag marriage will follow”
That’s exactly what Anthony Kennedy did in Texas when he legalized sodomy a few years ago. So Scalia was exactly right.
This isn't 1861. Americans of today don't have the stomach to murder millions of their fellow citizens over a purely political question of union.
Secession by one or more red states would provoke an awful lot of things, but it wouldn't include military aggression. Not in this day and age, and not by the cowardly left, who openly grovel to anyone who truly means 'business'.
Not sure if someone posted the article, India just “recriminalized” homosexuality. Really wish that could happen here.
