U.S. Attorney General Eric Holder said in a New York Times interview published Monday that state attorneys general arent required to defend laws they consider discriminatory, including bans on same-sex marriage.
Holder said that state attorneys general should carefully analyze laws that raise major constitutional issues before deciding whether to defend them.
Engaging in that process and making that determination is something thats appropriate for an attorney general to do, Holder told the Times.
To make his case, Holder said that if he were an attorney general in Kansas in 1953, he would not have defended a Kansas statute that put in place separate-but-equal facilities.
Six state attorneys general have decided against defending their states same-sex marriage bans from challenges, inviting criticism from those who argue an attorney generals job is to defend their respective states laws regardless of their personal attitudes towards those laws.

"U.S. Attorney General Eric Holder said in a New York Times interview published Monday that state attorneys general arent required to defend laws they consider discriminatory..."
Well, then. Given that abortion laws discriminate against the rights of unborn children, I say we get to work...
Then I guess the states do not have to enforce the ObamaCare law either, right?
I guess states don’t have to abide by any executive order by the lawless Obama, right. See, others can play lawless too.
Laws have become meaningless.
America is truly becoming a banana republic.
Since when does Holder have any authority over STATE AG’s???
Who is he to grant them permission to do or not do anything?
Can they also ignore EPA directives that they disagree with?
Isn't America (and the West) the biggest customer of the drug business? I remember those trite sayings from the 60's. Do you remember: "Bad laws are made to be broken"??
Insanity reigns when druggies reign.
AG’s are subject to the same professional ethics rules as any other lawyer. They cannot do harm to their client. The most they can do is withdraw over claimed conflict with no comments on merits of a case so as to allow somebody else to zealously defend their client.
Holder is trying to get some AG’s dissbarred.
AG advocates ethical malfeasance?
Using a reference to banana while discussing the current leadership in the US? Everything is racist, even normally innocent colloquialisms. Tread carefully.
For the list.
"I guess states dont have to abide by any executive order by the lawless Obama, right. See, others can play lawless too."
Yep. And the reality is, that may be the only way to stop them in the end. Sitting around yelping about the "imperial presidency" and "lawlessness" isn't working. Throw the left's tactics right back in their faces until this stops.
Essentially, the US is becoming a country where the law is made by those with more and bigger guns and can change on the whim of Supreme Leader.
It is the policy of the chief law enforcement occupant that there is NO NEED to enforce the LAW.
Keep that in mind.
Would Holder defend the rights of normal people in hard left states who don’t want their children inundated with the fag agenda?
Official stated policy of the DOJ is lawlessness. Do they not see that it will come back to bite them? When the government feels entitled to pick and choose the laws it enforces, the people will do likewise. The republic, and the rule of law, collapses.
Except executive orders ARE NOT LAW.
Article I, Section 1 of the Constitution says:
“All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”
What we often overlook is that little three letter word at the beginning. “All” does not mean “most” or “some”.
I do grant that we HAVE drifted from this Constitutional principle, but we need to get BACK to it! We also need to get back to federalism.
Who is he? Well, he’s the monarch’s Minister of Just Us.
“Holder said that state attorneys general should carefully analyze laws that raise major constitutional issues before deciding whether to defend them.”
Good. States can now refuse to obey unconstitutional dictates from Washington. We can start by banning fascist federal bureaucrats from states and giving black-robed commies 24 hours to leave.
"It is the policy of the chief law enforcement occupant that there is NO NEED to enforce the LAW."
And once again, the GOP is asleep at the switch.
