Dog Owners: Responsibilities after your dog attacks

LITTLE ROCK (KATV)--After recent dog attacks and even some that resulted in deaths, Channel 7 explains what liabilities dog owners face after their dog attacks.

Attorney Gary Green said a common misconception is the "one-bite" rule.

Many still believe that if their dog bites for the first time, they're not liable.

However, Green said in this day in age, where attacks are becoming too common, that rule is like an old wives tale.

In the last year, we have reported at least six dog attacks, the most recent; an attack on Thursday in Hot Springs Village, resulting in the death of a 75-year old woman.

While the village has no criminal statute for dog attacks, other counties and cities do, which could result in criminal charges for dog owners.

"You could be looking at up to manslaughter or some type of Class A Misdemeanor at least if someone is killed," said Green.

Green says the "one-bite" rule is no longer applicable in many dog attack cases. He adds, even if an owner asks why they're responsible if they didn't see it coming?

"The breed in itself breeds foreseeability, if that person who is asking me that question owns a Pit Bull, you should have seen it coming," adds Green.

He goes on to say that when it comes to bigger dogs and breeds known for fighting or protecting owners; such as Pit Bulls, Bull Mastiffs and Dobermans, it's best to keep a close eye on them and avoid possible attacks.

"You better keep them pinned up, you better be watching your dogs and as they grow older and crankier, be aware of that before it becomes a problem," said Green.

Not only can a dog owner face criminal charges, but civil suits are also brought forth.

Comments are interesting. Bad year of dog bites in Arkansas this year, with a 4 year old killed by 3 pit bulls recently in White County.

My rule has always been: dog bites person = dog put down. Is that hard?

Mrs. l got bit by the neighbors dog last year. It bit her on the finger leaving two small puncture wounds. She was in the hospital for a week fighting a very nasty infection.

The breed was a Jack Russel terrier mix weighing less than 30 pounds.

dog put down. Is that hard?


Ummm...yeah that would be. Especially if the dog is guarding a perimeter and barking a constant warning not to breach it.

People can be so foolish about their animals. Sometimes I think it’s because we all have such poor relationships with human beings, that we have to create a fantasy around pets. As much as we might wish, they cannot replace human beings in our lives

Yes—it would be hard to do—but it would be the right thing to do.

I don’t think my 2 Labradoodles are much of a threat.

Back when I was young and very naive, I had a pit bull named Bruno don Corleone-—I can’t believe how utterly stupid I was to buy that dog—we had 5 young kids at the time. (I gave him away pretty quickly when he ate a large portion of our 8 foot wooden fence.)

This assumes, without bothering to prove, that attacks are more common than in the past. If this is indeed the case, why not demonstrate it?

Benton County has a dog ordinance requiring all free running dogs, even in rural areas, to be pinned.

Never had a problem till the county paved the road, and the joggers took over.

The breed with the largest number of bites on humans to its credit is the Labrador retriever.

Sheesh.

I think they mean “penned” as in confined in an enclosed area.

Maybe that's because there are more of them than any other breed! After all, they have litters of 10-12.

I wanted to spell it “penned” but when I looked at the original thread they spelled it pin so I went with that.

“You better keep them pinned up,...”

Other words I have problems with...
sew (as in seamstress), sow as in plant a field with grain, sow as in pig.

Yes, the article does have "pinned" but if you listen to the tape the attorney says "penned". The problem lies with whoever did the transcription. Pinned would be Southern-speak for penned.
