It happens rarely. A taxpayer challenging the constitutional basis for the income tax wins in court, defeating the Internal Revenue Service, such as in the case brought by the late Tom Cryer, who was acquitted on a charge of failing to pay $73,000 to the government.
Now three members of Congress want to make that result the norm through a bill that would repeal the 16th Amendment, effectively canceling federal income taxes.

“A sensible import tariff policy could replace the tax revenue from income taxes.”
Reduce government to what it should be per the Constitution, and we won’t need to “replace” revenue from income taxes.
Excellent Point!
Not only abnolish it, but any employee of the IRS that has been involved in ANY criminal activity or unconstitutional activity while employed goes to jail.
In other words, we need to build more prisons!
Once again, Congress is hiding behind the IRS as the cause of all the taxation problems in this country. You, Congress, wrote and passed these ridiculous laws. It is you who screwed this country, not the IRS.
The irony of Russia’s flat tax is that the oligarchy had the power to impose it. They realize, just as the Heritage Foundation, that a simple flat tax will spur economic growth. Unfortunately, OUR oligarchy of career politicians, crony capitalists, media elites, and leftist professors all benefit from the complexity of the tax code. Farmers, manufacturers, pharmas, health care, solar, oil—the list is endless. Incumbency is the single most corrupting influence in our entire political system. Term limits is the only answer.
They also delegated regulatory power that they should have kept as legislative power.
This was really my (poorly couched) point... how did this not hit every news program and twitter account across the country?
It would seem that even the news media fears what might happen... and I am guessing that the IRS has opted to let this one quietly be closed on its own: for had they lost on appeal, then the scope of this case would indeed be larger and easier to replicate... even without a jury.
Agree
They would turn what industry America still has into just another component of the bloated welfare state. There's simply no need to compete when you have a captive market. That's one of the reasons why the Soviet car industry wasn't the wonder of the world.
Tariffs would also give the Government the ability to choose winners and losers in the domestic marketplace, allowing them to effectively enforce unionization and the rest of their whacked-out agenda
If you hand tariff power to the Government then your most important competitive act suddenly isn't to work better, faster, cheaper - it's to lobby the Government for interventions that suit your company.
Because once you allow Government to place a foot on the hose of production, negotiating with that foot becomes more important than anything else.
Finally - tariffs breach Freedom of Association. Why would we force Americans to buy something they don't want? If a foreign car is better, faster or cheaper than a GM Volt, by what right would we interfere?
If you truly want to bring industry back to America then remove the barriers to industry in America. Capital goes where it is treated best.
Reduce Corporate taxation. Also, simplify taxation. Tax fulfillment costs have become a significant burden on smaller businesses.
Reduce the vast panoply of EPA and other environmental regulations. Companies aren't going to relocate to a country where wood stoves can be declared illegal.
Remove arbitrary, vindictive Government (we all remember Gibson's guitars, I hope).
Get rid of Obamacare. America isn't France. Companies need employees to work more than 29 hours a week, and that's only a small piece of the anti-competitive madness pouring out from Obamacare.
Well, hope this was helpful.
Agree the IRS, for the most part, is just doing their job. I put the biggest blame on the Congress and Senate of 1913 when the income tax and Fed was established.
It's up to the people and the current leaders in DC to fix it. Kill the funding and the federal beast will necessarily return to its cage.
In the 50’s industry needed government.
Now,
Government desperatly needs industry.
Industry no longer needs government, in fact they can pretty much buy any governemnt they need. ExxonMobil’s “state department” is far more efficient then the US department of (screw ups) state.
What? get rid of the agency that acts as a giant welfare agency, taking money from those who earn it and passing it to those who vote for more money? The agency that keeps people off welfare by giving them a welfare check disguised as a job? The agency that hounds and harasses innocent hard-working citizens?
never happen.
Any tax plan needs careful consideration and much public debate. For certain, the boot of the federal government should be removed from the neck of average citizens. The states should ALWAYS be the conduit between the two, unless it is a matter of a state abusing rights of citizens as granted by the Constitution.
Holy prosperity Batman!
We might even become a super wealthy, super power if THAT happened !
I do believe you meant to say “offensive” in place of “defensive” since this is what most of these RINO’s have been doing on the defensive, instead of taking it to the liberal socialist.
The best defense is a great offense!
Never my friend is a VERY long time... ;) Eventually it will collapse under its own weight.
Well +1 to that and well said.
State-level subsidiarity in taxes would lead back to that thing which is the essential genius of The United States: competition in government.
Don't like the bloated government and high taxes of State A? Move to State B. Simple and ingenious.
Amen!
