My answer is that the request for Obama’s birth certificate underscores that the citizenship must be verifiable. Congress can determine what constitutes verification.

Man, you guys love to create fancy sounding phrases like “Citizenship acquired through the Constitution” and “legislative enactments of Public Laws” that are just, well, Conspiracy Theorists Stupid. There is no meaning of “natural born citizen” provided by the Constitution.
Therefore, it’s the domain of the Congress, since naturalization is the domain of Congress. To say who must be naturalized you must determine who does not.
I prefer that we all continue the free exchange of ideas and opinions.

It would be interesting to see what would happen, that’s for sure. A little too much at stake for me to feel comfortable playing chicken though... Especially when Roberts is probably the deciding vote.
My guess is that Hillary would try to get Cruz’s name off the ballot when it’s too late for the R’s to replace him. Or have him disqualified before he receives any electoral votes (Dec 15th)
It’s occurred to me that the left has been wanting revenge for Bush v Gore for a long time. Hillary would be a hero of heroes if she did these very things. More incentive.
I just read an article from 2 days ago, on yahoo ( http://news.yahoo.com/ted-cruz-natural-born-citizen-eligible-serve-president-100207138—politics.html ), it talks about how reasonable and critical it is to sort out the definition of NBC, but says that “purported concerns about President Obamas constitutional qualifications led birthers to file lawsuits challenging his natural-born credentials on the basis of a variety of far-fetched theories during the last several years.” The news media is going to legitimize the questions about Cruz’s eligibility in a way they never did with Obama. Cruz isn’t going to threaten the media into silence like Soros did for Obama, but instead the media will dutifully hound Cruz on Soros’ behalf. They’re setting the stage already.
The left doesn’t want to bring Obama into this ad bringing an eligibility suit to Cruz would do that. The USSC tripped all over itself to say no one had standing, practically eliminating everyone from it.
Furthermore, I can guarantee you that I have done more to prevent the spread of birther conspiracy theories on FR than almost anyone. Ask the boss, he’ll tell you.

You have been arguing that Cruz is a “statutory citizen” and such citizen are NBC and cannot be prez.
Copies of confidential Hawaii birth records can be released for inspection under an order from a court of competent jurisdiction. No one has bothered to go to a judge, make their case for the issuance of a court order (NOT a subpoena). A congressional committee of the House of Representatives, such as the House Oversight and Governmental Operations Committee would be the perfect body to approach a judge for a Court Order.

Yes, Cruz is a statutory citizen, but he is also eligible because Congress gets to say who requires naturalization. He doesn’t require it.
xzins position is that in the realm of definition of "natural born citizen," there is no need for constitutional amendment, because that term means whatever Congress enacts and implies by legislation, and this is the fashion and authority for definition that the founders intended.
Your point about doing that via elected representatives still attaches, but the threshold for making a change is lower for a statutory enactment than it is for a constitutional amendment.
FWIW, I disagree with xzins. I believe the founders intended the term "natural born citizen" to have independent fixed meaning - independent of statute, that is. "Rules for naturalization" play for people who are not natural born citizens, and Congress was expressly granted the power to open and close the gate of naturalization.

I have NO doubts that Hillary would do this if Cruz won. She would file suit to prevent any electors from being able to vote for him.
People have tried but were told the had no standing by various courts.
