The suit was filed in the U.S. District Court for the Southern District of Florida on behalf of Boca Raton-based employer Kawa Orthodontics LLP. It argues that the delay of the employer mandate “exceeded [the Obama administration's] statutory authority, is arbitrary, capricious, and contrary to law, and is otherwise unlawful.”

Pretty much.

“Obama had no authority to simply change the law once it had been approved by Congress and signed.” John Roberts didn’t have the authority to rewrite it without the changes going back through congress and the potus either. But we are in a post constitutional country anyway so what the heck.

That’s only one of the problems with having a non-American sitting in the White House. They think they can change “the law of the land” to suit their needs and the needs of their supporters. That might be okay in Kenya but that isn’t the way we do things here in America.

I'm sure King Roberts will deem it an administrative interpretation—not a change, or a chronological adjustment—not a delay, or something.

"...the delay “will allow us to consider ways to simplify the new reporting requirements.."

The retards shoulda thought of that and included it in the bill before passing it.

Since he’s already announced that he’s going to invoke the 14th Amendment to ignore both houses of the legislature and raise the debt ceiling on his own, I’d say Obama simply doesn’t give a damn.

And obviously, the courts are too scared to oppose him. The only ones doing anything now are our Representatives, including Speaker Boehner, who has obviously had a great awakening and realizes that Obama actually intends to shut down the whole system and simply grant himself an “Enabling Resolution,” ala Hitler.

“Kawa Orthodontics expended substantial time and resources, including money spent on legal fees and other costs, in preparation for the ‘employer mandate’ taking effect on January 1, 2014.
Kawa Orthodontics would not have expended its time and resources and incurred these anticipatory costs in 2013 if the mandate had not been scheduled to take effect until 2015, but instead would have spent its time, resources, and money on other priorities,” the action explains.

It seems that the elephant in the room is , although the framers of the constitution wrote it to protect the people from an ever powerful government, what was not considered is how do we the people deal with a run away executive branch. What is in place to deal with a violent overthrow of the constitution from the executive branch.
So far the other branches of government have done nothing about the illegal and obnoxious over reach from obamma mamba jamma lenin khomeini. In light of this we must conclude our country has been overthrown. I admire the lawsuit about obammas intention to rule as he pleases, with no government intervention telling the irs etc to comply with the law...in this mode duhbummers power grows daily. obamma should have been impeached years ago, and thrown in jail>>..he is not under the law and rules from fear..tyranny indeed is in the white house..

We have never been attacked from the inside, we have a president who is probably not even legally supposed to be able to run, and more than likely is in bed with Russia and the muslim world, rules by executive order and no branch of government challenges it.. We may as well default on the debt now because we certainly will in the future.. the executive will start seizing our property, our guns, and all of our freedoms while the mass of the country agrees.

Waste of time. There is no constitutional law now and might never be again. The law is what King Obama and his communists Democrats empire decides what it will be. Most of the Supreme Court are liberals and will not uphold the Constitution.

The courts will just say he doesn’t have standing. Only Obama has standing these days.

I don't know if it's the phase of the moon or the sign of the zodiac or cosmic rays or what. But, I am dismayed to read the comments so far on this thread. "We lose" is not putting up much of a fight. Post an article about someone fighting back and here come the naysayers. To quote the Boss of this establishment: "Damn the naysayers."

As a service, I provide this for posting on FR profile page as appropriate

I think it’s time to throw one lawsuit after another at this regime. In every state, in every jurisdiction. Just like they do at the American citizenry.

I want a class action citizens’ lawsuit against 0bama, Reid, and Pelosi suing them them for $330,000,000 ($1.00 per citizen) for failure to uphold the Constitution as per their oath of office. “Impeachment by Citizens”. Where can I sign on? (Even if its tossed, it would make a helluva statement.)

If Obama can get away with this, what's to stop him (and future presidents) from picking apart every new bill that's passed and becomes law. For example, let's say the GOP gains a veto-proof majority in both Houses of Congress next year in the elections and immediately pass and over-ride Obama's veto of a massive tax CUT that's supposed to be implemented February 1, 2015. What's to keep Obama from "delaying" the tax cut for 1, 10, 100 years by directing the IRS to do just that?
