The court actually ruled that he did not ‘rip it off’ consciously and with malice. The court ruled that he did so subconsciously. Yes, he lost the case but through no real fault of his own making.

I thought the Skye Boat Song referred to the escape of Bonny Prince Charlie to the Scottish island of Skye in 1746 after his attempt to overthrow the king of England had failed.

That is the traditional, and popularly accepted interpretation.
In "Into the Mystic" though Morrison refers not to: "Skye" as in the isle, but to "sky" as in the heavens. Thanks
