Day 23 (Week #5) Zimmerman Trial – Closing Statements

Today, July 11th, is DAY #23 (of 5th week) State of Florida V. George Zimmerman case.

Yesterday the defense rested its case. A legal analysis via Professor Jacobson HERE.

From my perspective the entire case ended, as expected, early in the day yesterday when Judge Nelson gave George Zimmerman his personal Platinum Express DCA Acquittal Card. The ruling, and more importantly the legal determination she used on the ruling, regarding the Trayvon Martin phone evidence was an immediate Nuclear DCA option. Nelson essentially ruled against admissibility based on ”authentication”. She could have kept it out under other legal reasoning, but no, she chose the one without the slightest chance of being upheld by a District Court of Appeals. IMHO this was intentional and aligns itself with the way she has ruled during the pre-trial discovery phase, and during the case itself. She’s a rigid ideologue, but she’s not stupid – this was intentional.

By ruling the phone records (texts and pics from Trayvon) cannot be “authenticated” to have originated by the specific personage of Trayvon Martin just gave the dismissal of the case to George Zimmerman with a bow on it.

As it was carefully explained to me, the phone is like a bucket. The data inside the phone is like marbles in a bucket. Some marbles from calls, others from pictures, others from texts, etc. The State brought the bucket into court – and validated the bucket contents with their own witness from the phone company – Both the State and the defense then began arguing their case around the phone call marbles in the bucket – Primarily with Rachel Jeantel. But no-one challenged the bucket itself. The State authenticated the bucket and the content of the bucket during the introduction.

The defense picks up the same bucket the state hands them, and now begins to use the contents – texts and pictures – and then Nelson rules the bucket itself cannot be authenticated. It doesn’t work that way.

If the state authenticates evidence, it cannot be divided and only authentic when the state holds it, but not the defense. Flawed logic – ABSOLUTELY positioned to give such a prejudicial outcome, the appeal would result in dismissal, not retrial. Nelson gave the case away to George Zimmerman.

She could have ruled on relevance, admissibility, or other factors – but she chose the one destined to fail, “authentication”. She gave it away.

In other news, people are catching on to the Eric Holder, Department of Justice, Civil Rights Division, Community Relations Service – being the actual puppeteers behind the entire construct of the false case. To them we say “welcome to the party pal“.

Dear P-Marlowe,

I was under the impression that if the persecution argued good character on the part of the dead thug punk, the defense could present evidence to impeach that.

Is introducing the [false] concept that the dead thug punk was actually a little angel during closing some sort of loophole? What recourse does the defense have? Can they now use evidence of the dead thug punk's thug punkery during their closing, perhaps even showing some texts?

Thank you for saying that. Z did not break any law prior to the confrontation. Why do we keep hearing that he did not follow orders? It doesn’t matter in any way shape or form to this situation. Did he break a law before the scuffle? The answer to this question is no. He had as much right to walk on the same sidewalk as Martin did.

Where I come from, if you cold-cock someone and start pounding their head into the cement ... and it turns out that person has a handgun on them ... well, your chances of being around to tell your version of events tends to drop dramatically. Whereas if the target is not armed, well, the odds of them being around to tell their version of events tends to drop instead.

So tell us, then, why you are pushing an anti-gun and anti-self-defense screed right out of DU here on FR? Maybe you could post a pic of 12-year old St. Trayvon while you are at it.

I thought I heard that, too. But it wouldn’t surprise me that she stops the persecutors 5 minutes from the end and give those 5 to the defense.

Sounds like you have been listening to rumors that started last year and have made your mind up. Obviously you have not been watching the trial where the FACTS have been presented every single day.

People with smarts and common sense have come to the conclusion that the 17 year old thug, and wanna-be-gangsta, wanted to fight and was shot only because GZ felt his life was threatened.

What George Zimmerman did was not unusual or illegal. Trayvon Martin chose to attack Zimmerman instead of just going into his home or calling 911.

Self absorbed TROLL, is what you are.

I’ve told you the law of this case.

You’ve been told that the prosecution has to prove that Z murdered Martin, that it was NOT self defense. They haven’t come anywhere near that proof.

Self defense trumps EVERYTHING you said. There is no evidence on the side of the prosecution’s case, there’s a ton supporting Z’s account of self defense.

Trayvon being alive to tell his side wouldn’t change the evidence. It wouldn’t change the law.

TROLL.

BEAT IT AND STOP DISRUPTING.

Failing that, we should ignore your mind-blowing TROLLNESS and move on.

That timeline is missing the video of TM at 7-11. That was at 18:24:18. 7-11 is a .9 mile walk back home. TM took 45 minutes to get from 7-11 until the spot where GZ saw him and called the police.

Forty-five minutes to walk .9 miles.
