I don’t have much faith in that process. I think the decent folk of Florida are outnumbered now. Actually, maybe some south Florida riots would be a good thing. Perhaps they should get what they voted for. I don’t worry about the Northern part of the state, or the panhandle.

Someone mentioned today that in florida that manslaughter inclusion is automatic. It would be if it were consistent with evidence. I would think that if the defense were to stipulate that GZ deliberately aimed at Trayvon before pulling the trigger, that would imply that a manslaughter charge would be inconsistent with the stipulated evidence.

Then I guess you have a hung jury..but what I worry about is not the 2nd degree murder charge, I dont believe for a second he will be convicted of that, but what I fear is the jury, not knowing the law about what a manslaughter conviction will bring, but say “What the hell, let’s convict him of something” and think that manslaughter will bring him 4-5 years when in reality its the same sentence as 2nd degree murder

What about Aggravated Assault? That was the other charge mentioned in the article.
Except Zimmerman was acting in self defense. And in florida you are allowed to use deadly force if you fear “great bodily harm”. Several witnesses testified that the head trauma he receieved was more than enough to cause a normal person to believe he was in for a serious beating, and even the injuries he received could have killed him.
And he doesn’t have to even prove that. He only needs to create a reasonable doubt. This is a classic self defense case. The man is guilty of absolutely nothing, except maybe double parking his truck.
