Today, June 28th, is DAY #15 (of 3rd week) State of Florida V. George Zimmerman case. [Yesterday] … it was simply not a very good day at all for the prosecution. The primary State witnesses today were Rachel Jeantel, Jenna Lauer, and Selma Mora.

The first had her credibility substantively destroyed, the second was powerfully–almost humiliatingly–co-opted by the defense, and the third provided testimony entirely consistent with the defense’s theory of lawful self-defense. (continue reading)

I was just watching national Fox and the Judge they have on is saying the Defence owns the day.

This is absolute BS. Be assured, if GZ wouldn’t have had a gun, he wouldn’t have been able to walk anywhere, maybe never. Trayvon would be working at a skittle factory, married to Rachel Jeantel.

Not possible. GZ is claiming self defense. It’s Murder 2 or nothing. The trial started once the jury was sworn in. Self defense covers lesser charges. Otherwise it’s double jeopardy. The state went all in on Murder 2 and bet on Rachel. Bad bet.

Thank you. Yes, I agree that makes sense.
Then again, I think this country has lost it’s mind currently so no sense is being employed.

I can’t even believe I’m watching this, there is nothing the prosecution has presented to convince me GZ hunted the TM like a dog, hat tip SLJ - this is getting to be a big waste of my time. Unless the state rests after today, I’ll wait for the defense to start with their witnesses.

IANAL but other than that I think throwing the case by the prosecution is as likely a scenario as any— the odd civility between BDLR and MOM that pops up from time to time comes to mind. If I were the prosecutor I would have given up before I had started. Maybe BDLR did not have that choice to make (and keep his job, at least). I think it is as least as likely as some of the legal conjectures that WFTV legal commentator Bill Schaefer is coming up with. BS also probably wants to keep his job too, and it’s safer to go with less outlandish hypotheses if one is on live TV, so if it is viable, it is a conjecture we are not likely to hear from most of the commentators.

An earlier poster pointed out that if you’re not guilty of murder because you were defending yourself, then you’re not guilty of manslaughter either. Killing someone in self defense is killing someone in self defense.

Theoretically, a jury could determine that the shooting was not in self-defense, but did not have all of the required elements of Murder 2 (requires malice or a "depraved mind"). In that case, they could convict on manslaughter. But first, the state has to prove beyond a reasonable doubt that the shooting was not in self-defense - basically to prove that GZ had no reason to fear for his life when he shot TM.

WFTV B. S. (legal analyst) is saying that this witness said in MMA style fighting the person on the bottom can throw punches or get up and so this proves GZ was not in great fear for his life.

So now Zimmerman is a MMA pro fighter who could have flipped the fight?

I thought Zimmerman was just a guy on the street getting a pounding. Why the sudden imputing of professional fighting skills onto him?

WHAT??? You mean they can change the charges in midstream?? It’s like they are saying...”Gee we can’t get him for this, lets try to get him for this”. This can be changed in mid trial? HOW UNFAIR is that????

Aren’t there a number of charges less than 2d degree murder?

Manslaughter is certainly one of them.

How about (from a website)

1st degree Murder
- Felony Murder
2d degree Murder (intentional, unintentional)
Manslaughter (voluntary, involuntary)

Justifiable Homicide
