A federal judge in Philadelphia has made a dying 10-year-old eligible to seek donor lungs from an adult transplant list.
U.S. District Judge Michael Baylson says he is granting the temporary request because of the severity of Sarah Murnaghan's condition.
Her mother, Janet Murnaghan, says the family is thrilled by the ruling. It's in effect until a June 14 court hearing.
The family is challenging organ transplant rules that say children under age 12 must wait for pediatric lungs to become available. The Murnaghans say that rarely happens.
Sarah's doctors believe they can perform a successful transplant with adult lungs.
Sarah has been hospitalized at Children's Hospital of Philadelphia for three months with end-stage cystic fibrosis.
On Tuesday, Health and Human Services Secretary Kathleen Sebelius declined to intervene.

Its what I have been saying since the IRS Scandal broke, if people think the IRS targeting Conservatives is bad, just wait til they control whether you lie or die, depending on your political beliefs..the left has already made excuses, saying that Conservatives deserved it..soon they will be saying that if a Conservative needs a transplant or has a disease that they deserved it too and the Govt will make sure that they don’t get the necessary care..the IRS was just the tip of the iceberg of what will be coming
There are two separate issues you are not distinguishing from each other. One issue is whether it is ok to get an exception made to a good rule, and the other is whether it is ok to challenge a bad rule. You can’t judge the situation and distinguish between the two cases, unless you are willing to actually evaluate the specific rule.
There used to be rules saying there had to be separate blood banks for black people and white people. It was eventually decided by the courts, after expert testimony, that this rule was not actually necessary and it was causing harm due to the lost opportunities for matching donors to recipients, and discriminating illegally.
Now there is a rule saying there have to be separate organ banks for adults and children, and it is claimed that this rule is also not actually necessary and causes harm due to the lost opportunities for matching donors to recipients, and discriminating illegally.
These situations are exactly parallel structurally. That doesn’t mean they must reach the same result, because the medical facts may be different enough to change the result, but there is just as much moral right to challenge the rule in court as there was to challenge the old rule about separate blood banks. Therefore it is unfair to criticize this lawsuit, unless you think it ought to be obvious that the current rule is best.

Wonderful. Now prospective transplant patients have yet another hoop to jump through, one with no medical training, no financial expertise, only a political agenda. And this will lead to improved care? This is going to lead lower costs?

Now the Democrats are going to get together to figure out how to challenge this so that they can kill the 10 year old and support Sibelius.
They have to find a way to stumble to the wrong side of almost any issue.
