A federal judge in Philadelphia has made a dying 10-year-old eligible to seek donor lungs from an adult transplant list.
U.S. District Judge Michael Baylson says he is granting the temporary request because of the severity of Sarah Murnaghan's condition.
Her mother, Janet Murnaghan, says the family is thrilled by the ruling. It's in effect until a June 14 court hearing.
The family is challenging organ transplant rules that say children under age 12 must wait for pediatric lungs to become available. The Murnaghans say that rarely happens.
Sarah's doctors believe they can perform a successful transplant with adult lungs.
Sarah has been hospitalized at Children's Hospital of Philadelphia for three months with end-stage cystic fibrosis.
On Tuesday, Health and Human Services Secretary Kathleen Sebelius declined to intervene.

she is 10, the age for adult lung transplant is 12- unless you want an abortion, then it is 10, or 9
several months ago a 12 yr old had an adult donor heart and double lung transplant
if his kid is close to the same size and weight as that 12 yr old, why does age condemn her to death? oh, HHS rules....
at least she is not an illegal immigrant
I didn't read anywhere that she's in front of the line just that she's been put on the adult list.
Just wait till the length you wait is determined by who you contribute to or what your beliefs are.
I believe the criteria to go to the head of the line are the criticality of the case and the likelihood of a good outcome, and other facors.

With CF, she has been on a waiting list for 10 years, since birth, She is 10, not gonna make it to age 12 “adult”
The doctors back the family and say they have a match for her. Assume they know her size and weight and suitability of the transplant for her
It's not going to do her much good to be on the adult list if she isn't bumped to the front of the line, is it?
Can’t her doctors get their pic of organs from Chicago or Tiajuana?

She’s just been moved from one list to another.
Dr Manny Alverez was on FOX this morning saying that the rules haven’t kept up with medical technology. Basically there’s no longer a reason for a separate list since they can now transplant a partial adult lung into a child and be just fine.
Her prognosis already makes her about a good a candidate as you will ever find and she’ll move immediately to the top of the adult list too.
Yeah, complete with investigations of what you pray for.

Don’t start rejoicing yet. The child has merely been approved to be placed on a waiting list. She reportedly has WEEKS to live. If Sebelius drags her feet a little, and/or throws a little bureaucratic gravel into the gearbox, she may even yet have the pleasure of seeing the little girl die!/S
She has less than a 20% chance to have a successful tx, with shaved adult lungs.Then a lifetime if anti-rejection drugs and probably another transplant. I know small adults who have been on the table to receive whittled down donor lungs and things went wrong. Wasted lungs.
Love it! If she'd had her kid screened by March of Dimes, she could have had the kid murdered (excuse me) aborted years ago. Then there'd be no problem.
And in the opinion of a transplant surgeon, the girl can benefit. So the judge is affirming a physicians opinion.
