Lois Lerner, the IRS official who headed the tax-exempt division when the targeting of tea-party groups took place, plans to invoke her Fifth Amendment right to refuse to answer questions before Congress on Wednesday.
But Republican Rep. Darrell Issa, the chairman of the House oversight committee where Lerner was to appear, has issued a subpoena to Lerner anyway.
The subpoena was delivered after the committee received the letter from Lerner's attorney, a committee aide said.
Her attorney, William Taylor, said in a letter obtained by National Journal, that Lerner had "not committed any crime or made any misrepresentation" but that she would decline to testify at a House hearing on Wednesday.

How can she refuse to answer congressional questions and still keep her job
at the IRS, since congress has oversight over the IRS. Would that not be insubordination or worse?
Low information voters may not think deeply, but when an adminstration official takes the fifth, they know what’s up.
Notice that Hillary never took the 5th on Whitewater, it was all “I have no specific recollection.”
If Scooter had done that, he’d be a member of bar and lobbyist in good standing today.
Tough luck. Make her publicly invoke the Fifth over and over and over again.
This is going to make some kickass TEA recruiting ads for ‘14.

Interesting the WH and Treasury were working together on exactly how to reveal this scandal to the public-a month before Lerner’s phony planted question, which Miller claims was his idea.

What do prosecutors do in a case like this? Often they give the witness immunity.Of course a grant of immunity requires a vote of the committee.What’s the requirement...simple majority? Two thirds?
Congress can request Obama to fire her.
But Congress can't make her testify against herself unless they offer her immunity. They can make her testify against Obama if they offer her immunity. But they run the risk that with immunity she will perjure herself to protect Obama. And the perjury might be difficult to prove.
I think they should convict her first for her role, and then demand that she testify about the White house involvement, now that she has nothing left to lose.
FWIW, she would have taken a constitutional oath as a condiition of her job. Be sort of interesting to quiz her on what she thought the “protect and defend against all enemies” clause means.
You can’t believe the RATS are letting her do this? They have to be ecstatic What is the alternative, that she and/or others conspired with the WH to target conservatives? Her options are:
Lie - that will get her prison time
Truth - that will get her and others prison time, not to mention names that
will lead to Obama
5th - that will stop the flow of blood to the top

This justmay be about pure self-preservation: saving her own ass. Assume she’s done lots of really bad stuff..worthy of a few years in a federal pen. remember, it’s really, REALLY hard to find a jury that will be impartial, let alone sympathetic, to a former IRS big shot who was abusing the taxpayers..so, this is all a ploy to get immunity for herself. Assume she spills all the dirt, Issa should happily give it to her..( but will the DoJ go along?) this will go right to the Oval Office..

King Obama will not fire her since he has to make sure that she stays under the communists umbrella to protect his butt.

Actually, if stuff really gets bad, I don't expect Obama or Hillary or some of the others to stick around for it. I bet they'll both be on their way out of the country (if they can find someplace to take them).
They both have plenty of money, and I'm sure some of it is already out of the country. The only problem might be that other countries would be afraid of them - that is, afraid that they might try to take over the governments of those countries.
Boehner needs to get a bunch of people taking the 5th and then pass a bill removing the IRS from Obamacare enforcement. Then offer the kenyan 2 choices: sign it or shut the govt down.
