Top IRS official will invoke Fifth Amendment

WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

Correct.
The 5th applies to criminal prosecution.
Go back and read your Miranda Rights. They are not rights. They are not rights but the 5th is. We have always had the right to remain silent under the Constitution. If the police show up and arrest me for bank robbery I know something is seriously wrong at the get go because I didn’t do it. I am absolutely the only one who knows that. If it gets to that point I plead the 5th and want a lawyer.
Miranda says anything you say can and WILL be used against you. Not may be or may exonerate you. It says will be used against you. If the prosecution has done their work properly your silence will not save you. Saying something that could be interpreted to help them even if you are innocent would help their case even if wrong.

And I am no bleeding heart lib by any stretch of the imagination.

And based on what I have read illegal things have happened and there is the carrot of a pardon if you keep your mouth shut.

That’s what the Bill of Rights is for. I hope Justice is served for violation of law and their sworn oaths ,but.... I’m not holding my breath.

I was simply responding to the incorrect statement that “There is no 5th amendment protection in a civil proceeding.” A witness can plead the 5th in a civil proceeding at the risk that the judge or jury will infer or presume guilt.

This woman accepts a salary and benefits paid for by the taxpayers of this country. If she will not answer for the harm that occurred on her watch then we need to stay on this until her grubby fingers are removed from our pockets. Let her find a different employer to mistreat. I’m sick of these “civil servants” taking our money while they poke us in the eye and laugh all the way to the bank.

I don’t know if we should allow this. After all, the Founders couldn’t possibly have known about IRS abuses when they wrote the Fifth Amendment. And anyway it only applies to muskets and the militia, not broadcast television and the Internet...

Federal Election Commission Enforcement Mar 31, 1998 Committee members heard testimony concerning Federal Election Commission investigation and prosecution practices. The particular incident in question was the FEC (Lois Lerner) refusal to pursue Howard Glicken for soliciting and funneling a $20,000 contribution from Thomas Kramer, a German citizen, to the Democratic Senatorial Campaign Committee in 1993. I don’t like the idea of immunity either, but if she can catch a bigger fish, it might be worth it.

I think it's too early for that. If she's guilty, she should go down as well.

There have to be a lot of people down the food chain who are only guilty of following orders and who would testify from where the orders came. Even though it will take time, start little and work your way up. Keep the heat on and people will be bound to get desperate and make mistakes.

There's a lot going on behind the scenes that we're not aware of and the the GOP is only becoming aware of.

No problem with hauling these people up before Congress and getting them to plead the 5th in person, but if there is a criminal investigation going on elsewhere, no need to grant immunity at this point.

There's nowhere for the guilty to hide. They'll be found out and brought to justice, even if it takes years and another administration.
