You've been framing this from the very beginning that it wasn't really so bad, not really rape, just consent from 16 year old girl who was just as bad, or just as wrong as the boys; or alternatively journalism exactly like the Zimmerman case.

Spotty and inferential? As I understand it, the boys admit they did it, admit that she was out of it, but said they didn’t think they did anything wrong because they didn’t have to force her to do anything. Am I mistaken on that?

What was to be learned from Penn State, their endowment is larger than ever...they had a pretty good season last year, things are looking up for their program....they’re doing great...ok, so they don’t get to go to some lame non-BCS bowl game for a few years, and as it turns out, that might actually be saving them money, seeing as how it’s been documented that schools usually lose money on going to bowl games.
Admittedly, not much.
However, I have heard no claim that the videos record the entirety of the participants (girl and boys) actions. Without that, and without the girl's recollections, I don't know how a rape charge can be sustained without violating "presumption of innocence."

There were witnesses. As I understand it, the guy in the front seat (whose girlfriend talked this girl into going to the party in the first place) admitted that he videotaped 2 guys raping and sodomizing her in the back seat of the car.
If what’s been said here is correct, we now know why that video went missing: the head coach told the guys to get rid of the evidence, which (if so) is also obstruction of justice.
This sounds like a mafia-type place. So dysfunctional that the guys thought they would diminish this girl by the story getting out, when in reality it only exposed their depravity - and apparently the whole place is just as depraved as the guys were. Their excuses and enabling is morally just as much to blame for all this as the boys who acted out what everybody was telling them from the get-go.

I don't know, but I have a hard time believing ANY defense attorney would go into court with nothing but "she wasn't conscious enough to tell them 'no.'"
As I understand it, the defense alleged numerous indications of her cognition and cooperation.
Obviously, the court rejected those claims, but I don't believe that rejection, in and of itself, proves the claims had no merit.
There is apparently proof that she became this drunk in less than an hour based on photos taken of her before, which makes it highly likely that she was given a drug, imo.
Now that it is pretty easy to retrieve meta data off of pictures, it’s pretty easy to create a timeline.
Age of consent in Ohio is 16.
It wouldn't surprise me to find she was drugged, it's seemingly likely that was the case. Unfortunately, we'll never know for certain unless someone confesses to drugging her.
