A mother and daughter who were mistakenly shot by Los Angeles police hunting for rampage suspect Christopher Dorner had no warning before bullets started whizzing through their newspaper-delivery truck, their lawyer said Friday.
No command, no instruction, no warning. They just opened fire on them, said Glen Jonas, who is representing Emma Hernandez, 71, and Margie Carranza, 47, in possible legal action against the LAPD.
They had no idea what was going on. Theyre huddling, covering up and praying and hoping theyre not going to die.
Both women survived. Hernandez, shot in the back, was in good condition Friday. Her daughter suffered a hand injury during the shooting and is now physically fine, but emotionally scarred, Jonas said.
The LAPD admits the predawn Thursday shooting was a case of mistaken identity that unfolded while police were guarding the Torrance home of someone named in a manifesto that ex-cop Dorner posted online about his twisted plans to avenge his firing.
Chief Charlie Beck said the officers saw a vehicle that matched the description of Dorners, driving through the dark streets with no headlights and a police-involved shooting ensued.
Jonas said the womens blue Toyota Tacoma looked nothing like Dorners dark-gray Nissan Titan, but that even if it had been a match, the police should not have fired on it.
They still have to give the guy an opportunity to surrender. You cant just execute him, the lawyer said. Its in these high-stress situations where you follow your training and they violated every piece of training they ever received.
The LAPD had no comment on Jonas claims.
He said he expects the city will offer his clients a substantial payout; if not, he plans to file a federal civil rights lawsuit.
Thank God they didnt die. Its a miracle they didnt, he said. If it was a movie, you wouldnt believe it.

These idiots should be up on charges of attempted murder and violations of 18USC242. Then they should be tried, convicted, stripped of their pensions, imprisoned for life, and sued into bankruptcy until their families are dead broke and starving in the streets.

Don’t know if they were warned or not, but my assumption was certainly that they were not. Should be criminal charges against the officers involved if in fact they just opened fire.
The ex-cop they are looking to assassinate may be right after all...........

The cops are scared to death. Remember when that guy threatened to beat up Barney Fife? I guess it’s true about bullies being cowards at heart.
If they think he is that stupid to do something like that, then they have underestimated him and they will never catch him.
These cops need to be fired..you cant just open fire on any car because it looked like Dorner’s vehicle. Luckily these two women were not seriously injured

Cops go nuts when one of their own is threatened and in this case they themselves are threatened. SOCAL folks better give them a wide berth until this perp is shot. I say shot, because it’s real clear he won’t be caught.

Also note, they were looking for ONE guy, yet the bullet holes clearly indicate that they were shooting at TWO people. Now yes, its possible that the suspect would have someone with him, but wouldn't you think that second person might be a hostage?
These cops need to go to jail for attempted murder.
