A mother and daughter who were mistakenly shot by Los Angeles police hunting for rampage suspect Christopher Dorner had no warning before bullets started whizzing through their newspaper-delivery truck, their lawyer said Friday.
No command, no instruction, no warning. They just opened fire on them, said Glen Jonas, who is representing Emma Hernandez, 71, and Margie Carranza, 47, in possible legal action against the LAPD.
They had no idea what was going on. Theyre huddling, covering up and praying and hoping theyre not going to die.
Both women survived. Hernandez, shot in the back, was in good condition Friday. Her daughter suffered a hand injury during the shooting and is now physically fine, but emotionally scarred, Jonas said.
The LAPD admits the predawn Thursday shooting was a case of mistaken identity that unfolded while police were guarding the Torrance home of someone named in a manifesto that ex-cop Dorner posted online about his twisted plans to avenge his firing.
Chief Charlie Beck said the officers saw a vehicle that matched the description of Dorners, driving through the dark streets with no headlights and a police-involved shooting ensued.
Jonas said the womens blue Toyota Tacoma looked nothing like Dorners dark-gray Nissan Titan, but that even if it had been a match, the police should not have fired on it.
They still have to give the guy an opportunity to surrender. You cant just execute him, the lawyer said. Its in these high-stress situations where you follow your training and they violated every piece of training they ever received.
The LAPD had no comment on Jonas claims.
He said he expects the city will offer his clients a substantial payout; if not, he plans to file a federal civil rights lawsuit.
Thank God they didnt die. Its a miracle they didnt, he said. If it was a movie, you wouldnt believe it.

Sorry but no they won’t get canned, they may get a few weeks paid vacation and then a disability retirement benefit but that’s about it. Expect to see them let off, also the MSM is down playing this like crazy so don’t expect any citizen anger either. The one nice thing about this is that cops are off the streets, I usually see at least two or three CHiPs on the way to work, this morning I saw none and there were two separate accidents one with the fire dept there and you always see cops when the fire trucks are on scene.

Someway, some how they will come up with charges to be placed against these women.
As has been mentioned, what would happen to any of us in these circumstances? Tried, convicted, bankrupted by lawyers and civil judgements, families dead broke? Yep, yep, yep, and yep.
Shea, right. They are covered by so many exemptions except intent.
Intent and malice will get them jailed. Making a big Azz mistake won’t.
Any regular citizen would be up on manslaughter + more and then sum more....
if you read the manifesto before it breaks down into a rambling, the guy has some legitimate beefs - those alone coupled with the cop killing assure he will not be taken alive - and be damned any law abiding civilian caught in the cross fire
They did it. And will get away with doing it.

They’re already laying down some breadcrumbs — I myself don’t believe for a second that the woman was driving without headlights at 5 AM.
Should be convicted and hung for attempted murder.
