The Manhattan man who posed a formal challenge to President Barack Obama's place on the Kansas general election ballot Friday requested immediate withdrawal of the appeal due to an avalanche of criticism.
The Kansas Objections Board had taken the complaint filed by Joe Montgomery under advisement on Thursday, pending requests for official copies of Obama's birth records. The ballot issue was tied to Montgomery's assertion Obama wasn't a qualified candidate for president because of his citizenship status and that of his father.
"There has been a great deal of animosity and intimidation directed not only at me, but at people around me," Montgomery said in the formal withdrawal request to Secretary of State Kris Kobach. "I don't wish to burden anyone with more of this negative reaction."
Kobach, Attorney General Derek Schmidt and Lt. Gov. Jeff Colyer had planned to convene the state board on Monday to consider new documentary evidence regarding Montgomery's claim that Obama should be dropped from ballots.
Kay Curtis, spokeswoman for the secretary of state, said there was a tentative plan to conduct the meeting Monday. The procedure remains unclear, but it may be necessary for the board to formally accept Montgomery's decision.
"This is kind of unprecedented," Curtis said.
I hope SOS Kobach and the Kansas officials reject the withdrawal request, seems like that would be within their authority. After all, it certainly appears the request is being made under duress. I think Kansas has an obligation now to protect Montgomery and also rule on the original challenge based on the evidence they’ve requested from Hawaii, Arkansas, and Mississsippi.
Unfortunately, not.
"There's no possibility of Obama's name coming off the ballot when there's no objection," Kobach said.

Montgomery's plans to drop his challenge were first reported by the Manhattan Mercury. The Objections Board would be the final word on whether Obama appears on the ballot as the Democratic Party's nominee, absent a court challenge. Kobach and its other members, Attorney General Derek Schmidt and Lt. Gov. Jeff Colyer, are all Republicans, and Montgomery is a registered Republican, according the secretary of state's office.
Kobach said the board still will meet Monday to formally close the case and add whatever additional information is available to the record.
"There's no possibility of Obama's name coming off the ballot when there's no objection," Kobach said.
I guess we’ll see. They are still going to meet Monday without Montgomery.

You should lay off calling the guy names. HE brought it up and had the guts to go to court with it. It’s now in Kansas voters’ minds, and if he goes even further public with the fact that they’re threatening him, that’s MORE publicity.

Were hoping to obtain that over the weekend, Brad Bryant, the states election director, said of Mr. Obamas birth certificate. And then they will reconvene Monday in the morning to consider that document, put it in the record and then make a decision on whether the name of Barack Obama will be on the ballot.
Good luck trying to get a copy from Hawaii.

The board has asked the authorities in Honolulu, Arizona and Mississippi for documentation to verify the authenticity of Mr. Obamas birth certificate. Its also trying to settle the separate question of whether the president is a natural born citizen, since his father was Kenyan and, in the view of some conspiracy theorists, the Constitutions definition of natural born means having two citizen parents. Theyre wrong about that, but it hasnt stopped them.
I do think the factual record could be supplemented, said Mr. Kobach, who is also an informal adviser to Mitt Romney.
I expressed a similar thought in #21. I see no reson why they can’t include any info they receive in a public report even if they take no action regarding the ballot challenge.
