Government can tax what it wants, if the court approves it.
I agree with you 100% that government can tax anything, as allowed by Benedict Roberts’s ruling.
My issue is that right now the GOP holds the senate so government is not all Democrat right now.
The only reason Obamacare originally passed was because the Democrats had majorities in the House, Senate, and White House. The Dems did not get a single solitary GOP vote for Obamacare in either house. The Democrats do not have majorities in all 3 houses now, so they cannot just place a tax on anything without at least some of the Republicans voting with them.
I never said the tax would lose based on the Constitution. You are right in that now that Roberts has made taxes unlimited in scope and range, the government can tax anything they want, but it still has to pass both houses of Congress and be signed by the President. If one of those 3 institutions refuses, then there is no tax.
