The SCOTUS Just Woke Up a Sleeping Giant (Vanity)

One Republican Congressman, whom I believe they said was from Arizona, just said the same thing I said after this Ruling:

"Today, the Supreme Court awakened a sleeping giant. This changes the Election drastically." This has so angered people and will cause many to realize, this is no small matter. This is no game. We MUST Elect Mitt Romney, and a GOP House and Senate on November 6, 2012 so this ObamaCare Mess, our new Tax the Supremes gave us today, can be repealed and totally dismantled.

I believe this "victory" for the Obama Thug Brigade in the White House, will be short-lived. This will fire up people who were somewhat lackadaisical about this Election. We have to get the Marxist out of the White House.

It ain't over Mr. President. WE'RE JUST GETTING WARMED UP!!!

No one who has read the Federalist Papers can remotely claim that the government created by the constituion allows such.

And yet, I doubt anyone reading the anti-federalist papers would be much surprised... they correctly identified many of the problems, not of the Constitution per se but of the [corrupt] people using such a Constitution.

Just as important we need to win a majority in the Senate and especially get rid of McConnell and replace him with DeMint.

A large majority in the Senate would be helpful, but we only need 51 votes to repeal Obozocare. It was passed by reconciliation, it can be repealed by reconciliation. Of course that assumes Romney wins and Republican leadership has the cajones to do it.

It was pretty good.

I am wondering, if Romney wins, can Romney just “waiver” everybody?

Does Romney NEED a Congressional Act?

Obama has already taught us that the President can ignore Congress, has he not?

I have read all the Threads and I have not seen ONE FREEPER that Posted that they Voted for Romney in the Primaries. In fact, I never saw anyone who was “giddy” about Romney being the presumptive Nominee either.

If you know of a FReeper that did, give us a name. I won't hold my breath. I'm still waiting for the last guy I asked the same question of two months ago to get back to me.

Agree, disagree, whatever, but don't Post silly assertions about your fellow FReepers you cannot prove.

According to SCOTUSBlog, while Chief Justice Roberts concluded the mandate is a tax, he also rejected the Commerce Clause arguments in favor of the mandate. This is significant, because it will limit the ability of Congress to adopt additional mandates in the future. No one will be able to claim such requirements are not a tax, and this will make such requirements more difficult to enact.

Equally important, the majority narrowed the Medicaid provisions substantially in a way that limits Congress’s power to impose conditions on the receipt of federal spending. Specifically, the Court held that Congress may attach conditions on the receipt of new money — in this case the Medicaid expansion — but that Congress may not condition the receipt of funds for separate, pre-existing programs on compliance with the conditions for the new program. In other words, if states refuse to go along with the Medicaid expansion, they don’t lose existing Medicaid funds. If my understanding is accurate, this opinion would mark the firmest limit on use of the spending power in decades, and could constrain lots of future mischief.

UPDATE: Just to underline the point about the spending clause, the vote to narrow the Medicaid expansion was 7–2, as Justices Breyer and Kagan joined the Chief on this.

The Supreme Court’s ruling on Social Security gave the precedent to let the present Court use the “tax” reasoning. In FLEMING vs. NESTOR the court ruled:

To engraft upon the Social Security system a concept of ‘accrued property rights’ would deprive it of the flexibility and boldness in adjustment to ever changing conditions which it demands.” The Court went on to say, “It is apparent that the non-contractual interest of an employee covered by the [Social Security] Act cannot be soundly analogized to that of the holder of an annuity, whose right to benefits is bottomed on his contractual premium payments.”


Social Security is not an insurance program at all. It is simply a payroll tax on one side and a welfare program on the other. Your Social Security benefits are always subject to the whim of 535 politicians in Washington.


The Court’s decision was not surprising. In an earlier case, Helvering v. Davis (1937), the Court had ruled that Social Security was not a contributory insurance program, saying, “The proceeds of both the employee and employer taxes are to be paid into the Treasury like any other internal revenue generally, and are not earmarked in any way.”

For 50 plus years the liberals have been transforming our country before our eyes. It may take many years to reverse course in order to win the war against the liberals. Losing one battle ought to reinforce the importance of November 2012 elections as the start of the renewing of America. We must vote in a veto proof majority in the Senate, retain the House and vote out BHO and his islamist, communist mafia. November is around the corner and 2014 is just around the bend.

This should be a call to arms to everyone to vote out the liberal elitist thugs and those on the right, i.e. RINO’s and their lackeys, who have become corrupted by the lure of power in DC.

We must be the iceberg to the 50 year liberal Titanic agenda, else we truly are a lost nation.

Not exactly true.. the law as written states, YOU BUY THIS PRODUCT, OR IF YOU DON’T YOU MUST PAY THE TAX.

Government has always had the capacity to TAX and then spend the money as it sees fit.

What Happened today was a COMPLETE expansion, now say RUtabaga Incorporated wants to sell more rutabaga... before it could try to convince the government to enact a tax, buy rutabaga with it and then do whatever it wanted with it, give it to the people let it rot in a warehouse, whatever.

NOW, with this ruling, it is perfectly fine for the government to say, YOU, the INDIVIDUAL MUST BUY RUTABAGA, whether you want it, need it or can even afford it, and if you don’t we are going to tax you.. and we all know if you don’t pay your tax you risk jail time. So, Now the fed can tell you BUY THIS OR GO TO JAIL, no matter what the product or service is.

You all who think an election can (or will) change this just don’t get it. Even if Obama is booted and Obamacare is repealed this ruling on govt authority and the definition of what a tax is, remains. The govt. has a new power today and forever regardless of who is elected.

We need to start educating the people and politicians about the ability to impeach judges who violate their oaths of office and rip our constitution into pieces with ridiculous, twisted opinions. Fix this by impeaching 2 or 3 Supreme Court judges and a handful of 9th circus judges, and the rest will start actually following the law.

I think this may have finally awaken a lot of people who thought it didn’t make much difference who was elected since they weren’t particular fond of Romney.
