It has been stated on this thread that Chief Justice Roberts is another blemish on the record of President George Bush. I would like to address that point.
President Bush was not someone I could support a good portion of the time. I have railed on him here many times over the years.
When it comes to appointments to the court, they can look pretty good when they are made and voted upon. Years later, they stand a good chance of being viewed quite differently.
When President Reagan appointed Sandra Day O’Conner, it’s my understanding she didn’t look bad. Today we consider her to be quite a liberal SCOTUS Justice.
When Roberts was approved, we were all quite happy about it. He seemed like a good choice. Now we’re aware that at least with regard to this Obamacare ruling, he’s Dufus Maximus.
I don’t think we should blame President Bush for this anymore than we should blame ourselves, since we were in favor of Robert’s appointment.
This sucks, but Chief Justice Roberts should be the focus.
This is one instance where I’m not going to take Bush to task.
I thought Roberts was a good selection. I never saw him screwing a ruling this badly.
And yes, he really f’d up on this one. His ruling was an embarrassment to himself. It was an embarrassment to the court. It was an embarrassment to the nation.
Citizens have every right to be furious about this.
Roberts has said, in so many words, Obamacare's soft underbelly is that it's a tax. Meaning Congress can have at it. It's a creature of Congress, they can unmake it in like kind.
Like Paul544 just said, 'Congress could, in theory, pass a tax code revision that says the penalty for not having insurance is $1.'
I believe it happened the day of SCOTUS’ conference on Donofrio’s eligibility lawsuit. That’s the day Roberts issued an unprecedented and unethical ex parte invitation to Obama to visit SCOTUS. Deliberately timed the same day as the conference to give the maximum appearance of corruption - as a red flag that he was compromised. The botching of the oath of office and the “re-do” never being videotaped was another red flag. I suspect that Justice Souter (?) addressing Joe Biden as “Mr. President” was another deliberate signal. As was Dick Cheney’s failure to ask for objections during the electoral count.
Because I'm pretty sure puts all kinds of restrictions on what insurance companies can do. It sounds like they essentially become agencies of the government based on how many rules they have to follow to be allowed to operate as insurance companies.

It stands. But it can be repealed. Chances of repeal are that much greater now that is universally understood as a TAX
It doesn't have to go anywhere. It was construed to be a tax as is.
Based on this ruling, nothing needs Congressional action except the MediCaid portion that was struck down.
The current law allowed criminal sanctions for non-compliance. The SC disallowed this, and allowed sanctions as a tax only. It appears it WILL have to be re-written.

Absolutely. To many people have know idea what a nightmere it is once the g’mints get its claws in you.
Whether its the IRS or the EPA.

And thank you again. It’s a nice little glimmer of hope on a day that is primarily depressing and frightening. I’ve seen first hand what places without freedom can become. My only solace is that I don’t have too many years left and no kids who will suffer under tyranny in America.
But you can avoid paying income tax by not making any income. I can’t think of another tax that you MUST pay or be jailed. It might as well be a tax on breathing.

Roberts just justified his decision by stating that the mandate could fall under the taxation powers of the government. The Commerce Clause is used for many of the same things, but it doesn't redefine everything under it's umbrella as commerce.

I agree that the ruling does not force this to be rewritten. The ruling took away Congress’ ability to use the Commerce Clause as a backdoor forced tax. If the Democrats had tried to pass this disaster the legal way as a tax, it never would have passed. How now to pay for it?
The House now has the ball. It is up to us to play this under the ‘legal’ process. We have the power to kill it. Will we?

How many Democrats running for re election will stand with Harry? I don’t think too many will unless they come from big lib states. Tester, McGaskill ? I don’t think so.
