Juana Garcia, the widow of Idelfonso Martinez Sanchez, who died crossing the Arizona desert in April after being deported, claims the U.S. Border Patrol is responsible for her husbands death and now wants justice to be done.
After a failed attempt at crossing back into the country from Tijuana, Sanchez employed the help of a coyote (human smuggler) and began the arduous trek through the Arizona desert on April 20, Garcia recently told EFE.
However, after only one day in the desert Sanchez became ill and the coyote along with the rest of the party left him behind.
On April 26, Border Patrol agents discovered the mans badly decomposed body on the Tohono O'odham Indian reservation, a commonly used smuggling route for both drugs and human cargo.
Garcia said: They could have saved him. They let him die worse than an animal - because we're Mexicans and we have no documents they treat us the worst way.
Garcia, who admitted to EFE that she is also in the country illegally, has five children between the ages of five and 19.

I was unaware that the BP is charged with assuring the safety of transborder drug-dealers and invaders.
My gosh, wow.
How ‘bout suing the coyote? How ‘bout staying in your own country when you are deported? How ‘bout ....? oh never mind.
Illegals dropping dead in the desert, then suing us?
Sounds like Omoslem’s wet dream.
When will the families of the 9/11 hijackers sue because the twin towers were right in the way of those planes?
Well, one invader is dead so I'm thinkin' one U.S. Gubbmint Issue .40 for the surviving Guacamolean should just about level the scales of justice.....
GET OUT - STAY OUT - EAT $#!^ and DIE in the DESERT!
Lady, too bad about your husband.
That said, think for a minute about what you are asking. American citizens cannot expect the police to protect them in the cities. Court decisions have said as much. If the police fail to stop a crime that they could reasonably have been expected to stop, they are not liable.
You are asking that your husband, an illegal alien, illegally crossing a dangerous and sparsely populated desert, be guaranteed successful lifesaving efforts by an overstretched Border Patrol. You are asking for a security guarantee not available to US citizens in their own homes.
Besides, think of what the Mexican courts would say if a US or Central American citizen died illegally traversing Mexico, and his family sued because he wasn’t saved.
If our courts take this seriously, we are more than done for.
She has balls bigger then her and her husbands brains combined. She is suing a country she broke into while she probably collects welfare for all her children. It’s time to deport this dead weight.
Absurd! You’re an illegal alien, you idiot.
You have no rights.
She needs her a$$ thrown back across the border to that sh*thole country she came from.
Whadda country! The “american dream” is alive thanks to the U.S. taxpayers. She isn’t suing “the Border Patrol”, she’s suing us.
Tip of the ice berg. For even more egregious examples, click the link. It will turn your stomach.
I thought it was settled case law: No law enforcement agency has any duty to protect anyone. They only act AFTER an illegal act is discovered, to investigate the crime and catch the involved criminals. . .
Based on this thinking, wouldn’t it be possible for OBL’s wife/wives to sue?
That's not the BPs' fault.
Suing us?
I bet a Clinton-appointed judge will give her standing....amazing.
Does this woman understand that soveriegn nations are within their rights to repel invaders with deadly force?
Yet we did not do that.
The coyote would kill her.
These illegals have so much chutzpah because they have a legion of support groups backing them up. La Raza has hundreds of these groups all over the country. They use different names to make it sound like they are all independent. Guess what? We give millions of dollars to LaRaza.
There is nothing we can do about it. Any politician even tries to limit or end any financial support to illegal aliens and the media will have a hissy fit. One state just recently lowered its tuition to state colleges for illegals. I could just spit if I knew how.
