A federal appeals court is striking back after President Obama cautioned the Supreme Court against overturning the health care overhaul and warned that such an act would be "unprecedented."
A three-judge panel for the 5th Circuit Court of Appeals on Tuesday ordered the Justice Department to explain by Thursday whether the administration believes judges have the power to strike down a federal law.

Yes. One my law school professors had him as a Con Law lecturer at UChicago. In class one day a student asked a question (unrelated to the law we were studying) and the professor replied "Ah, that's a Con Law question. You will need to ask Prof XXXX or Prof XXXX about that. Oh and for the record, my Con Law instructor was Barack Obama, therefore I learned absolutely nothing about the Constitution."

The court should not ask what the administration believes. It is of little consequence - it is what the court believes that is at issue. Repeal the law and teach the administration about the Constitutional separation of powers and if he makes one weaselly peep, hear one of the natural born suits and disqualify the usurper. It time the court stop the nonsense and defend this constitution.
